Please Help

I need some advice about my dog. My lease says that I am not allowed to have a dog. Well about a year and a half ago we bought a dog and have had no problems. Two months ago we got a letter from the management company saying they found out we had a dog and get rid of him. I spoke with a couple of other people who have dogs and got the same letters and they said to ignore them. Today I got a letter in the mail with my rent check saying they will not accept my rent until this matter is resolved. Does anyone have any adive or have been in a similar situation? I am so upset, our dog is part of the family. I would be devastated if I had to give him away. Please if anyone has any advice I would appreciate it.

I would move. I wouldn't give up the dog.

I don't think there is a way out of this, afterall you did know that werent allowed to have dogs- it was on the lease!

I would move as soon as you can to a dog friendly apt building. I don't think you have any legal recourse since you signed the lease. Good luck!

You have rights, please FM me and I will explain it to you. You don't necessarily have to move, and you do not have to get rid of your dog.

The only legal recourse you might have would be if the management company knew you had the dog all along and only now decided to say something about it. If they did know, they have already given consent to you having the dog in your apartment. If not, you only have two choices. Move or give up the dog. Personally, I would move. One question I have is why did they accept your rent check for the month after they sent the notice to you and will not accept it now? I would inquire as to when they found out about the dog. If you ask around, I am sure someone would be able to tell you.

I didn't post this initially because I feel the same as the other posters. I would definitely look for a place that accepts dogs before I gave up my pup.
I really don't think you have any recourse. The rules state you aren't allowed dogs and if other's have dogs and haven't gotten in trouble, what can you do.
Maybe yours is bigger or louder that the others...I'm not sure.

All I do know is - I wouldn't give up the dog and I don't beleive you are going to be able to stay - so I would look for another place.

I wouldn't give up the dog, I would look for a new place to live. My apt. complex doesn't know that we have a dog, but dogs are allowed, we just never told them because it was $300 non-refundable deposit, and then and extra $30 a month in rent. Good luck with whatever you decide.

There is a law that if you have a pet for over 90 days your landlord, management company CAN NOT legally make you get rid of the dog. I live in a co-op and the management office did the same thing to me....they sent me numerous letters and stop cashing my maintenance checks. I had to get a lawyer but I won because of the 90 day clause. FM me if you need more info.
