**Update with how it went**Tomorrow is my hearing
I am anxiety-ridden tonight. I can't focus on getting things done. And I'm going through other issues at the moment as well.
I feel like I'm going to break-down. I want tomorrow to come so its over and done with. But I'm also scared.
Its like 6months ago is coming to bite me in the a$$ again. I'm just so
******Update*******
I wish I had some good news to report but its all still complicated.
Let me start by saying I will find out the final decision within 3months. 1 person is the deciding factor in my hearing the person who heard my case. It then gets forwarded to another head honcho who either approves or disapproves what the guy at my hearing decided.
With that all said here is the complicatedness of my case. My status with the DOE played a huge part. Apparently I was presented in the system as a sub, when in reality I had been an appointed teacher. Because I signed a commitment letter with the DOE last summer I was designated as an RTR when I didnt find a job by the first day, I found a job the second day teachers came back from a job fair hosted by the Recruitment office. Somewhere down the line my school never changed my status from RTR to Tenure track but the changed me to ATR which is generally is the same as RTR. Anywho because of that my hearing was changed from a hearing about a Discontinuance to just a U rating Hearing. Because Subs can't be discontinued.
Now here's the thing both the Principal and AP are no longer part of the DOE so the person representing the school was the New principal who I've never met and only had documentation and the words of the other AP and UFT Chapter Leader to go on.
The school sent documentation that was in my file, not suprisingly things were missing. Like my observation that was "never written" up formally but was done formally and received an S rating. Plus some other docuamentation dealing with reqests for personal days.
Being that now my case was being tried differently, some of the documentation presented was thrown out because the relevance was not there. We went over want can and was presented and my lawyer did a good job of defending everything listed. The principal didn't have much to ask other then hypotheticals and claims of heresay. Closing arguments were said and then I was told about the 3 months itll take to receive a decsion.
Here's the absolute kicker. Because I was heard as a sub and not an appointed teacher if I don't win this case I can NEVER work in a NYC public school. Because Subs with U ratings can not get jobs, which is why I couldn't get a job this year I found out when I met with my lawyer.
So is it over?...no Do I think I can win?...It can go either way in my opinion.
One or rather 2 men hold my fate for a future as a NYC teacher, which is where I wanted to build my career.
On top of everything else going on in my life at the moment I can't help but feel there is a constant rain cloud following me around the past week.
Sometime around the holidays Is when I expect to hear the decision, until then I still have all this looming over me.
Thank you to everyone who has given me support during this whole ordeal. Now its all a waiting game. And once the decision is made I will let you all know what happened.

Oh wow, man that sucks!
I'm confused though, there are teachers who have received U observations but have been able to continue teaching.
Or were you not asked back. Also, what is the diff between RTR and ATR?

If you receive a U rating in your first year your probation will be discontinued. I received and entire year U rating not and observation U, I had gotten an S on my one observation. I received my U rating for insufficient classroom management.
RTR is regional teacher reserve, only teachers who sign commitment letters and dont find jobs go in that pool. they then are a assigned to a school as basically an in school sub.
ATR is absent teacher reserve, this is what excessed teachers become if they dont find placement. again they are assigned to a school and serve as an in-school sub.
However ATR's are appointed teachers who had tenure track or are tenured. RTR's are first year teacher who were never appointed a postion. RTR status terminates Dec 1st of each year if they dont find an appointed position.

Re: **Update with how it went**Tomorrow is my hearing
I had 6 observations my first year.
Plus I know people who had 2 u's and got an S for the year.
AND how do they say you have poor classroom management with only one observation? How do they even have a leg to stand on with no observations on file? Did you have a mentor?

That is what was thrown out, with no formal observations how can you say classroom management is poor, because of isolated incidents of kids fighting. Proper documentation should have been filed for a formal observation in order to give such a rating. While management is needed to effectively teach there are many more things to look at in terms of how teaching and learning is occuring in the classroom.
Without the observation the case is weak in their favor and benefits me not to mention the actual observation I had was rated an S. I had a mentor from january-April NOt from the beginning of the year.
6 observations whoa! are you in a NYC school?

Yeah, that's how we roll here.
6 first year with at least one by principal. 4 years 2 & 3 with at least one by principal
1 each year after tenure.
I thought that was standard for all NYC schools?

OMGosh no!
At the elementary level its a minimum of 2 observations, usually they give 3. Until you are tenured. After tenure its 1 or you can do an Alt to Obser. Which is like writing a term paper.
Are you secondary ed....maybe its different?
