Quick question - is the school in violation of his IEP?

My son goes to our district's integrated preschool. They technically have two sessions but he stays for both.

His IEP states that transportation is to be provided.

This week, Wednesday through Friday, the school only has half days. My assumption is that they will bus him after the first session to his destination which is daycare. That is where they usually take him in the afternoon because I work.

I called them yesterday in the morning to ensure they were on track to change his bus schedule due to the school day change for the next few days.

They told me they would not provide him bussing for the three days because it isn't his normal bus route.

I'm so annoyed at this. It isn't even so much that I have to leave work for three days to drive a half hour each way to pick him up and drop him off at daycare. They know he has such issues with change in schedule. And when he sees me in the middle of the day it just makes it worse and totally throws him off.

Are they in violation of his IEP by not providing bussing for him?

At this point it doesn't really matter. I picked him up yesterday. I'll do it again today. He won't be going tomorrow. But I just want to make the point to special services because their coordiantor was so nasty with me yesterday and even his teacher agrees that this won't work for him.

Do they drop him off at daycare at the end of the school day or do they drive him home?

If they drop him off at daycare at the end of a full day of school then yes they should have drove him to daycare for a half day. If they drive him home then that is where they are legally suppose to drop him off at half days. I do not beleive they can just change bus routes without special permission.

yes, they normally drive him to daycare in the afternoon. Which is where he need to be dropped off these few days. So no, no change in route. Just change in time.

I definately then think they screwed up on that one then. I would contact your services coordinator to make sure that doesn't happen again. I'd send them in a bill for the mileage that you did from school to daycare and make them pay. I'm sure it's not alot but its the point!

It sounds like a violation to me. If they are providing busing for all the children after the first session, which they should be, then there's no reason they should not be taking your son to his regular drop-off point.

I've left 3 messages with his social worker and sent off an e-mail to the director of special services this afternoon. No response yet.

Send another email and copy the superintendent. Or call the director again and let her know since you've had no response you'll be calling the superintendent directly.

Perfect advice!

My older son's IEP was not followed by our home agency. He was suppose to have a supervisor once a month to follow the t/a's answer question and such. Well long story short she showed up Sept/Oct. and that was it. After alot of phone calls, seeking legal advice I found out that IEP's are our childrens legal documents and if broken there are consiquences. Problem is you have to hire an attorney and fight. So I basically threatened my district, called our Superintendent and within 2 weeks the agency was fired and now we are using his day school as a provider.
So yes they must follow the IEP!
