If you weren't returning to work after birth
DH and I are leaning towards me not returning to work after the baby is born. DH thinks I should give notice 2 weeks before my due date if baby doesn't come earlier. I am thinking I should give notice asap to allow them to find a replacement for me. Baby is due in 6 weeks.
I don't want to come back after the birth because I hate where I work. A lot of promises were made and things have just gotten worse over time. If I go out on std I will have to pay back both the employer and employee portion of health insurance premiums if I don't return to work and the amount i would get on STD wouldnt even cover the premiums. If I do return to work I have to pay back the employee portion and return for atleast 30 days to avoid paying the employer portion. well just have to pick up cobra for myself for a month or 2 because my insurance is better than DH. Dh can pick up insurance through his job due to a life changing event. The baby and I can then be added to DH insurance in January when the new policy starts.
Is my logic wrong? I don't know if I'm missing anything in my thought process?

I would give your 2 weeks notice before you plan leave. I know it's a risk of the baby always coming early but I know where I work they would likely give me an end date to avoid an overlap in salary. I'm not going back after the babies get here either. However, with that said, FMLA is all my own time sick personal etc, I plan on giving notice while on leave so I can get paid for my time. I will also offer to end my leave at 10 instead of 12 weeks if they want me to train someone. However if I were in your situation, I would do it 2 weeks before your leave date.

I didn't go back after I had my first. I knew o wasn't going to go back when I went on leave. My leave wasn't paid though and I wasn't under their health insurance. I also had a trained replacement while I was out that I trained before I left. I gave them my two weeks notice two weeks before I was set to go back.
If it was a paid leave and/or I was under their health insurance it would have been diff.

...also I had to be employed while I collected state short term disability.

See I'm not under state short term disability. It's private through my company. Besides the std I won't have any other type of paid leave if I went out. Even though I hate the place I want to do the right thing.

I didn't resign until my maternity leave was up even though everyone knew I wasn't coming back. I understand wanting to do the right thing, but there's nothing to stop them from firing you or replacing you immediately and forcing you out before you want to leave

I knew I wasn't going back to work before I went on maternity leave. Some of my leave wasn't paid and I told them a couple weeks before I was supposed to return to work.

I gave my notice 2-3 weeks before I was supposed to go back. I had accrued 11 weeks of time off and I wanted to be paid for that time, if I had given my notice before I left on leave, I only would have gotten paid for what I had accrued for either sick or vacation (I forget which) and would have lost 6 weeks. That was what most people did because of their policy. I believe they have changed it since because it was a real problem.

Depending on the maternity policy, if they give you anything paid, they can ask to be reimbursed.

If I wasn't returning to work then I would have waited for STD and vacation time to run out before giving notice, however, in your situation if you are not getting any paid leave whatsoever then I don't see the issue with telling them early.

2 weeks only. You could go in tomorrow, tell them you aren't coming back and they could decide to let you go right then and there. You then lose 6 weeks of pay.

If you are definitely not going back and you want to leave on good terms, I'd tell them now. If you're not sure if you will return, then don't tell them yet.

I get std through my company but I'd have to pay back both employer and employee health premiums which would actually cost more than what I get from STD.

I think it depends on if you eventually want to return to the work place. I'm a firm believer in not burning bridges. I plan on coming back but if not, because of what I do (and I'm in a union) I would give notice ASAP, only so I would not burn any bridges.
If I was never returning to the workplace (or at least not for YEARS) where I wouldn't have to worry about using them as a reference or bumping into someone down the line, I would give the 2 weeks notice.

Why couldn't you go on your DH's insurance right away? If you stop working and lose your health insurance, it's considered a life changing event, and he can go on his policy and add you as a dependent. At least that is how it is at my company and my DH's. Is that possible for you?

DH insurance is terrible and has a high deductible. It would cost more out of pocket to be on DH insurance when I give birth then it would be for me to keep Cobra for a month or two.
