Trump's anti-transgender bathroom policy doesn't do much

WASHINGTON ? President Donald Trump outraged LGBTQ rights supporters on Wednesday when his administration eliminated Obama-era federal guidance to schools aimed at protecting transgender students from bullying and discrimination.
But it’s important to note that Trump’s action, while it may seem mean-spirited, didn’t change anything legally. The same federal and state laws that protect transgender people against discrimination are still in place, and Trump’s move has no effect on them.
The guidance that President Barack Obama’s Departments of Justice and Education issued to school districts in 2016 was just that: guidance. It wasn’t legally binding. It directed schools to accommodate transgender kids’ desire to use school bathrooms and locker rooms that reflect their gender identity.

“The guidance ... didn’t create law,” Vanita Gupta, the DOJ’s civil rights chief under Obama, told NPR on Thursday. “The guidance simply enunciated the Justice Department’s interpretation of Title IX and what federal civil rights law requires of schools. It was based on a decade of case law. It was based on proven best practices that, frankly, a lot of schools around the country were already implementing at the time that we issued the guidance.”
... Trump got rid of that guidance, but he can’t get rid of Title IX. And Obama’s interpretation of that law ? that a student’s gender identity should be viewed the same as the student’s sex ? is the opinion of a federal appeals court and more than a dozen district courts that have tackled related issues over the last 15 years.
The only difference now, without that guidance, is that transgender students would have to go through more of a hassle when suing a school for discrimination, because they’ll have one less tool to assert the right to use the restroom of their choice.
“They have access to the courts, even without the guidance,” explained Sarah Trumble, deputy director of social policy at Third Way, a centrist think tank. “It’s just a heavier burden for them to vindicate those rights without the guidance.”
It’s also worth noting that Obama’s guidance has been frozen since August, when a judge in Texas blocked it nationwide. ...
Basically, this is what I get out of this, and other articles related to this.
1. Obama just made a federal guideline, not a law or EO. 2. It was held up in court, so it wasn't even active. 3. The actual laws are made and supported at the State/Local level
So.... all he did was make a big public showing to make his base happy, and piss off and scare the transgender community, and those that support them. He didn't make any actual change in any law or policy.
He's doing a lot of that. Big, showy signings of pieces of paper that make his supports salivate, and scare or anger a lot of people. Much of it isn't actionable (or even understandable), so it's basically like shooting blanks into a crowd.

In fairness - Obama's policy didn't do anything either.
Obama put out his guideline for the same reason Trump did - to appease his supporters.

In fairness - Obama's policy didn't do anything either.
Obama put out his guideline for the same reason Trump did - to appease his supporters.
At least what obama did was a step towards progress and acceptance.

Well it obviously isn't any new feelings since separate mens and womens bathrooms have been around forever. They could have just had a general bathroom when it came to public restrooms.

Personally I have no problem with unisex bathrooms. Does not matter to me. What I would really like to see in the world of public restrooms is a childrens only restroom. My 5 year old DS does not want to go in the ladies room and I am not sending him into the mens room alone. And it is not because I don't trust the other users, it is because I don't trust him.

I dont think the issue is on the surface of adults using public bathrooms, but rather how a law would affect all areas such as middle and high school locker rooms for example...
The feelings of my DD who doesn't want to see a penis in a girls school locker room is just as valid as the transgender kid who wants to us the girls locker room...

I dont think the issue is on the surface of adults using public bathrooms, but rather how a law would affect all areas such as middle and high school locker rooms for example...
The feelings of my DD who doesn't want to see a penis in a girls school locker room is just as valid as the transgender kid who wants to us the girls locker room...
I'm honestly curious if kids really get naked all over the locker room at school? Maybe when you're on a team? But honestly, I feel pretty confident that a transgender kid who would already be dealing with a lot would not just get naked in front of everyone. I was not transgender and I am pretty sure for gym if I had to change (we never took showers as far as I remember - there wasn't time) I was either in a corner trying to keep everything as covered as possible or I went into a bathroom stall. I NEVER saw anything like the locker rooms I remember seeing in 80s movies.

Yeah, me, too.
The only genitalia I see in locker rooms these days is when I go to saunas and spas (co-ed) here (no bathing suits are allowed). Parents bring their kids, too. That really freaks me out, but it's the norm here and that's how they are raised. It's not being sexualized; it's the human body.

I never got naked in my locker room at school. Even in the years that I was on the swim team we all changed in private stalls. We certainly were not running around naked. Not at all like they show on TV.

Believe me a transgendered kid, with everything else they are going through and have to face on a daily basis in this ****** society, is NOT stripping down letting all their parts air out in the school locker rooms. They're already self conscious enough as it is. They want to be accepted for the gender they identify with, they're in no rush to wave around the only penis in a locker room full of vaginas. I imagine the reverse is even more difficult. I wasn't a transgendered kid and I was like a ninja in the school locker room finding new covert ways to change in and out of my gym clothes without even showing my underpants. There was no way I was letting naked parts hang out. If I had to I would've used the bathroom stall.
And nobody else was running around naked either. Everyone was equally self-conscious.
