Having an issue with my sons school

We aren’t eligible for regular bussing based on how close we live to school

Our oldest son is eligible for bussing based on his IEP and has been getting special transport bussing since kindergarten. He is going into fourth grade.

Our middle son is starting kindergarten.
He is not able to go on the bus with our oldest because he doesn’t have an IEP.

We are trying to get our middle son on the special transport bus with our oldest son

Has anyone dealt with this or know where I can find more information on this topic?

I had two kids - one with special transportation and one without. There are no laws in your favor. The special transportation is only for kids of need and written into the iep (legal document). I know how much it sucks but I don't think this is something you will get. Just getting a child with special needs special transportation can be a fight.

I understand its not what you want to hear - but I would start looking into plan b.

Your middle son will not be eligible to ride the bus. There is no way around that. If they were to offer it for your son, they would have one less seat for a student and would possibly have to re route students.
