Buying a home - permit question

Has anyone bought a home where you discovered that the work that was done did not have the proper permits?

What did you do and/or how was it resolved?

Any advice for this type of situation?

Yes... although hopefully I am using the correct terms.

Work was done on the property that, according to the town, would require permits. This additional work is not on the most updated survey filed with the town.

DH and I put a bid on a townhouse with no CO for the deck. the owner refused to get one (it's not free) and refused to dismantle it. we didn't end up buying the place, that was one of the reasons.

check with the town... there is a chance that back taxes would need to be paid on something that has no CO.

Thanks so much for posting this! There was some major work which touches on plumbing and electricity - makes me very nervous. Chat Icon Plus with the walls closed now I am curious as to how this would be inspected.

I'd say about 50% of homes on LI have something that needs a CO & doesn't have one.

I would definitely ask them to take care of it. the burden should not be on you! especially now that the market has shifted to more of a buyers market Chat Icon

If you are in Contract, check your Contract. Most C/O issues are the responsibility of the Seller and are not the obligation of the buyer.

It's still their house, therefore their problem, it is close to impossible for them to sell it without clearing it up, whether the deal is w/you or any other buyer. It might come as a "surprise" to them, but thats just the way it is.

It depends. When we sold our home we were clear with all potential buyers that we were not responsible for CO's and we sold on the first open house. We had a deck. As they only did an exterior bank inspection to the front of the house they never saw the deck. this was good for the buyer in the long run because they are not paying extra taxes on the deck. BTW: The deck was brand new, only 6 months old. Their inspector said it was well made so apparetnly it was good enough for them.

I would agree on the plumbing and electrical though. Did they do the work themselves? I'd be more leary of the house then. They mifght be willing to leave money in escrow to cover the costs of the CO's. They might already have another house and may not want to be hung up with the extra time to wait for the CO's to clear which can take months.

If you are that unsure, go with your gut and walk away.

Thanks for all of your help! We just heard back - no permits and no intention to get them so we have to walk away from this house. I am so sad because we were ready to put an offer until we found this. Chat Icon

On to more searches....thankfully we have a great real estate agent!
