If you have unused sick/personal/vacation time and you leave the company do they have to pay you out?

I think so as long as you have accrued that time. i've been paid for time that I accrued but did not use when I left my old jobs.
ETA: i think it's for personal and vacation time not sick days

well at my old job it was all lumped together. I am owed over 40 hours of time and they are refusing to pay me out.

I don't believe they are required by NY law to pay you. In some states (eg. California), you are required to pay them for vacation & personal days that are already earned.
eta. My company (NY) only pays for unused earned vacation time, not sick or personal.

I think that in NY the norm is to pay out accrued vacation time but not sick time.
However, I believe that COMP time must be paid out and any overtime that was accrued in the form of personal time off has to be paid out.

It's all about the accrual. In some cases, you would have to pay THEM for using Unaccrued time.
