I can't even believe what just happened-advice needed-Edited to add pics
As I am typing this I still really can't believe what just happened a few hours ago...DH and I were sitting down to dinner when his mother comes over (she lives next door) and is banging on our door..DH goes outside to see what is the matter and it turns out both of our cars that were parked in front of our house (we live in a cul de sac) were just hit by another vehicle...The driver of the other vehicle states that he was parked in our next door neighbors driveway and that he was in the house when the car jumped out of gear and went down the driveway hitting into our cars (are cars were parked parallel to e/o and were facing east-he hit them so hard they are now facing south) He claims he wasn't in the vehicle but we are pretty sure he was and that he had been drinking (his wife and daughter came to the scene and his daughter drove the vehicle home not him) My husbands car is fairly new (2003) and it is wrecked so badly-but probably not totalled since it is worth a lot of money-my car is older (1995) and is pretty badly damaged and most likely totalled...DH is freaking out b/c we probably wont get much money for my car and we aren't in the position to buy a new car...we reported the accident to our insurance company and to his and we are going through his for the repairs and rental car etc but they told me I have to wait until tomorrow to hear from an adjuster so we both can't get to work since neither car is driveable...DH is talking about suing the guy but I really don't know how that kind of thing works? I keep thinking that will cost us more money we don't have...

maybe get that guy checked out for DWI, but then again how can you prove he was driving if no one saw him and he claims he wasnt...

Sorry I forgot to mention that we did call the cops but they couldn't give him a breathalizer or anything since no one actually saw him driving the vehicle-the cop said not to worry that he sees this guy on the road alot and he'll be keeping a better eye on him now and that it is 100% his fault and that is insurance will pay--our problem is the book value on my car isn't going to be enough to get a new car
ETA I guess we didn't hear the crash b/c we were inside the house with the ac's and tv on sitting towards the back of the house about to eat dinner...his mom heard it b/c she was out in her backyard

I'm trying to add some pics we took-they aren't the best b/c it was getting dark fast on us (the jeep is the one that hit my DH's car causing his car to hit mine) Image Attachment(s):

The insurance company can total your car & then you can get it fixed on your own after you buy it back for a fraction of book value. Not sure if that helps but I know plently of people that have done it.

2 months before my wedding some idiot u-turned right into my car right under a no u-turn sign. He was 100% at fault. He said he would pay then when he heard how much he didn't. He tried scaring us saying our insurance would go up even though he was 100% at fault. Well we went through his insurance, we had a rental car and we had no headaches. They took care of everything. Try not to worry about your car yet until you hear what the exact estimate is and what his insurnace company will do.
The situation sux--- I am sorry.

You can sue him for the deductible on each car and for any other out-of-pocket expenses you may have. Even if he claims he wasn't driving, it doesn't matter. This guy is a menace and, unfortunately, he's going to get off pretty easy. I'm so sorry about this. It really stinks.
