Is there anyone who knows anything about Labor Laws? Like if all employees have a certain benefit, the boss can't deny me having it?

Is there anyone who knows anything about Labor Laws? Like if all employees have a certain benefit, the boss can't deny me having it?

The short version is I asked to have my DH covered under my medical insurance & the boss says "No". His reason is that they have since switched insurance providers & my business no longer offers that option, to expensive ect..........All other employees have spouses covered.... can he really do this?

I believe he can...The reason is that health insurance is a bonus an employer offers his employee. There is nothing that states he has to. He can charge you up to the fullprice of the contract, and he can offer a family contract for a limited time unfortunatly.

I work in health insurance. We have had people pay a years worth of insurance premiums to their bosses and have those bosses close up shop so to speak and the insurance if not paid is cancelled, and the employees cant do much about it but fight individually with the employer.

When you accept a job its things that you have to consider...reputablity...trustworthiness etc...


I would suggest maybe asking if you can pay more to have him covered, its probably true the rates went up and hes under no obligation to pay any more for an empoyees health insurance. Its unfortunate though.

I am a full time employee & there are SEVERAL other full timers in the same job position who have their spouses covered. There are also many others in different job catogories then me, but also full time who have their spouse covered. The boss pays the total amount for my insurance.

When I was hired.... one of the things I was told was that spouses are entitled to coverage also (& paid by the company). I actually requested to add my DH 3 years ago when we first got married & the boss said no. But I did not fight about it because he was starting a new job with benefits to come in 90 days. Yet 2 months after me, another full timer (same type of job, but he is a manager) got married & added his wife.

Basically the boss told me the other day that since we changed providers 2 years ago, the company no longer offers this. He says I was hired based on being a single person. They did not factor adding in someone.

But why is it that the guy gets to cover his wife 2 months later?Chat Icon

that is not legal. Why don't you call your insurance company and tell them on your own that you need to add your husband? They will then contact your company and let the manager know what's what.

No they wont actually. We The insurance company have a policy with the employer..not the people they employ...There is nothing the insurance company can do...we cannot add someone to a contract unless the employer wants to.

eta- You may be able to contact the State and if you can prove that the same "class of employee" that you are was offered a employee/spouse contract and you were not, and your situations are 100% the same...they will investogate your boss to see if its fair practice...They may force him to clarify the benefits and if he cannot prove what he did was warranted they well pressure him to offer you the same benefits...The issue is that they pressure but dont follow up on it, although your boss may not want to deal with any backlash and give you that family policy regardless.

Your boss sounds like a complete jerk, but unfortunatly what he is doing is completly legal. They can offer you insurance and take it away without any warning. Health insurance is not mandatory is a "perk".

Is there a higher up then him or is he it??

Unfortunatly again, all he is guilty of is being a real jerk and a pain to work for. Im sorry...
