HR Question ...

A friend of mine signed on with a company back in March to be a sales person.
He basically received a letter stating his duties, his compensation (base plus incentive) and the last line of the letter read something along the lines of "a minimum of a 2-year commitment at 'said' company."

He signed the letter, along with his boss.

He didn't get a sign on bonus, there was nothing regarding noncompete clause ... it was just a statement saying he is committed to the company for a minimum of 2-years ... It mentioned nothing of the company making the same commitment to him in return (the company policy is employment at will...)

Legally, what are his options if he wanted to persue another job? Is the letter a binding contract to keep him at his job, even though there was no sort of compensation for signing on or a commitment from the company to keep him?

He's really unhappy and wants to persue other options but is unsure of what to do. It's like another 1-1/2 years being stuck somewhere he hates.

Any advice or insight?

This happened to my old boss's husband, he was woking for a large acctounting firm. He had to sign a contarct about employment. He was able to get out of it.

NYS is employement at will for both the employer and employee. It might be some sort of non-compete agreement. I would tell him to ask his HR rep. They could explain it confidentially.

There is nothing confidential about this company, believe me... I feel so bad for him. I told him to take his chances and just find something new.
