Does the tree guy have the right to bill me?
We had an estimate in october, but the tree guy said he would get to us "when he was int he neighborhood again" and would contact us, well, we thougth he forgot about us and we decided we would do the pruning ourselves to save $500, I guess sometime last week he was in the neighborhood and decided to trim our trees (we weren't home) and we had not heard from him in 5 months, so now I get this huge bill in the mail meanwhile we would of declined his services if he would of just called us, what do you think?

I would call up and dispute the invoice. I would NOT pay for something that I did not okay.

I would call him up and let him know that you have no intentions of paying him as you weren't contracted for his services. If he gives you a hard, remind him that he trespassed and damaged your property without permission and you are doing him the courtesy of not perusing legal action.

This sounds to me like the office or billing person had you on a list of work in that neighborhood and after the guy did the work in the neighborhood, they just sent a bill to everyone on that list.
There is no way I would pay that if they didn't do the work or if you never signed a contract.

thanks so much for everyone's input, he did the work, but not without contacting us! He gave us an estimate in october and said he would conact us when in the neighborhood, he never contacted us, and came and did the work while we were out and never even called or anything! The uncomfortable thing is I really like this guy, he is really nice, but why would he just come do the job 5 months later without calling? What if we didn't even live her anymore?

As a pre-emptive strike against any kind of reprisal, you might want to let Consumer Affairs or the Better Business Bureau know.

What if we didn't even live her anymore? we had the previous owners' pest guy come spray the house not once, but 2 times without our consent!
he said he had forgotten she moved and tore up the bill. since he was so nice about everything and admitted to his mistakes, we decided to sign a contract with him moving forward...

Call the company first and state your case- you have to give them the opportunity to rectify the situation, not that they can take back trimming your trees, but they can void the bill. They should have definitely called you prior to coming. I work for a tree care company during the summer and our "estimator" will often tell someone that when he is in the neighborhood, he will take care of the tree- it is NEVER unannounced, I can't imagine anyone going on to someone's property 5 months after the fact.

If the guy is nice about it and I wanted him to come back in the future, I might try to work out a compromise - pay half the bill since you did some of the trimming before he came.
