Question about Deck Co's......
The house we are buying and should have closed on weeks ago has no CO for the deck. The town will not give one to the sellers because it is too big....so now they have hired an expeditor who is trying to get a variance. My question is after this is done.....how much will the taxes go up on the house. Has anyone been in this situation? Also, the town will need to send an inspector to the house and we are worried that he will go through the entire house and see the bathroom in the basement and the converted attic which can all increase the taxes. Do you think they will go all through the house or just look at the deck. The taxes are already over $8000...we can't afford for them to go up much higher. The house is in oceanside(town of hempstead) if that matters.

I'm not sure how much it will bring your taxes up. But from what I know and have experienced with the town of hempstead, when using an expiditor it usually takes about 3 months for just COs and more towards 6 months for a variance. We had to have the seller get a couple COs with the expiditor for our house we just purchased and that is what 2 lawyers told us. Our 3 COs took 3 months total. The wait is so rough and the process is like a roller coaster ride! What does your lawyer have to say? Will this effect your mortgage commitment/lock in?

Usually the only one who has a problem with it is the bank. I had a few lawyers tell me that if they are working for the seller they now put in a clause that is something like an "as is" clause. The buyers have to accept the deck as is and will be responsible for any co's in the furture. If the buyer's bank has a problem with it then the deck gets taken down.
