LATEST NEWS ON UKRAINE ADOPTIONS


NEWS FROM UKRAINE (Posted September 22, 2005)

Dear Families,

We consider it our duty to inform you of all the latest information about adoptions Ukraine. The update below will most likely cause you to feel concerned. We hope that you read this keeping in mind that international adoption is an ever-evolving and ever-changing process. Those of us who work in international adoption agree that change and occasional instability is to be expected. News of change come frequently and we have to patiently work to determine what the news really means. Below is a piece of news that we feel is important to share with you, but we, just like the US Embassy in Kiev below and authorities from other countries, are still in the process of gathering information to better assess what it means for our families and what can be done about it.

The National Adoption Center in Kiev posted an announcement on its front door stating that due to non-compliance of a number of families with post-placement report requirements, the National Adoption Center is no longer accepting applications from citizens of Canada, France, Germany, Italy, Spain and USA, effective September 19, 2005. The note bears no reference to any official documents or government decrees. No time frames or any other details are provided. Reportedly, the director of the NAC is out on vacation until early next week and is unavailable for comment. This note affects only the families whose dossiers have not yet been submitted to the National Adoption Center. Families with dossiers already at the National Adoption Center are being processed and adoptions are still taking place.

We understand that this is alarming news to you and we sympathize with you. We are gathering more information and are waiting for an explanation from the Government of Ukraine. As noted in the note of the US Embassy in Kiev below, this news is very unexpected and abrupt with no explanation offered so far. It affects families from several countries who comprise most of the foreign adoptive families in Ukraine.

Please be patient while we are gathering more information. We are closely monitoring the situation and will update you as soon as more information is available.

NOTE FROM US EMBASSY IN KIEV


Ukraine - Adoption Suspension on New Dossiers

On September 21, 2005 the Government of Ukraine informed the U.S. Embassy in Kiev that the National Adoption Center (NAC) of Ukraine was suspending the acceptance of new adoption dossiers from U.S. citizens and citizens of several other countries. According to the NAC, the decision to stop accepting certain dossiers as of September 19 was based in large part on the past non-compliance of some families with post-adoption reports, which are required by Ukrainian law.

The Embassy has asked for further explanation from the Government of Ukraine regarding the premise behind this decision. The Embassy has also expressed concern about the abrupt nature of the decision and the fact that it was taken with no advance notice to, or consultation with, the countries affected.

According to the NAC, the new procedures do NOT affect dossiers that have already been accepted, unless the prospective adopting parents have failed to register and provide reports about a previously adopted Ukrainian child.

The Embassy will continue to track this issue closely and is discussing next steps with the State Department. Updates will be posted on the Embassy's webpage at .





New Mandatory 10-day Wait in Effect (Posted September 21, 2005)

This update is important because it involves changes for families who are both new and in-process. Please read.

Ukraine adopted a new Civil Code on 09/01/05 and it is already in effect. The Civil Code determines proper court procedure, including adoption. The new Civil Code replaced the old optional 30-day wait with a new mandatory 10-day wait. The purpose of the 10-day wait is to allow an opportunity and a time frame for appeals (same as Russia). Now after the judge rules in favor of the adoption, families will have to wait for 10 days before the ruling goes into effect. This means that all other actions associated with the adoption, such as obtaining the children’s new documents, will have to also wait. It is mandatory in all regions and it means that our families will now have to stay in-country 10 days longer. Just like in Russia, if necessary, one parent can leave for home after court and let the other one complete the process in Ukraine.

Yes I too am crying....what beautiful children.... You know I hope to have a child soon but I had always thought I would adopt too. I may be coming back to you for more info...

Sandra,

Like I said in my FM to you, as far as I know, the children who were just here in August are ging through with adoptions. My aunt and uncle are adopting a child they hosted this summer. So are a number of other families.

So, I'm not sure if the information you posted is across the board or only specific areas/orphanages.

The easiest way to find out would be to call the agency and ask them what the policy is now.
