Having major problems with the house we are buying!!!!!!

Ehhhh...I am starting to get so fed up.....We were supposed to close weeks ago and now all of a sudden there are all these major issues. The first issue being that there is no CO for the deck. The sellers have been trying to obtain one but the town will not give them one because it is too big.....so now they have hired an expeditor who is trying to get a variance but in doing so he informed us that now because of this other issues can arise. In order for them to get there variance...the town must now send an inspector over that will go through the entire house.....our lawyer says this will open up a can of worms because now they will see the attic that was converted into two bedrooms and the apt in the basement which they don't have permits for any of them.....so now the big issue becomes the taxes because we have no clue how much they can go up and they are already over $8000. In order for this all to be settled it will take around 6 months and we wouldn't know anything about the taxes until then. Plus our mortgage expires on Tuesday...so if we don't close by then we lose our rate.....and I really don't feel comfortable closing and having them leave money in escrow when I know nothing about the taxes. Right now we are deciding if we want to back out which the lawyer says we can. It just totally pisses me off that we wasted all summer waiting to close when we could have been looking for something else.....not to mention the fact that our baby is due any day now. What would you do?

Did you not know they didnt have CO's for the attic and apt in the basement?

No we didn't know...lawyer discovered it. Its actually the bathroom in the basement thats the problem not really the apt because they can work around that by taking the stov out! The converted attic is the biggie though because that is a big increase in living space which effects the taxes.

I was going to ask why didn't you ask if they had the CO for the bedrooms upstairs. But then I thought about it and if it looks "normal" you wouldn't think to ask in the first place!

Damm shady sellers.


I would have the town come in... do the inspection... let the town know they have to raise the taxes on that house... then back out. Chat Icon

Let the seller try dealing with another buyer and selling with the higher taxes. Chat Icon

Sometimes the back taxes become an issue too (no CO for the deck and rooms) and can really add up. Is the seller going to be willing to cover this cost? Sounds like too much aggravation for me. Chat Icon

The sellers are totally shady...don't you remember a couple weeks back when we had the issue with them over the antique tub?

While this "plays out", start looking around. Who knows, you may find something better.

Though you've had so many headaches with this house so far I have to say that it just may not be worth it in the end. It sounds like this is going to open up a can of worms. This has to happen for a reason, like a better house out there. Is there any way you could recoup the money you spent on trying to buy this house (inspection fee, termite inspection, retaining your lawyer, etc.)? Sometimes these are "signs" that this is not the house for you- things that are meant to be like this should have a smoother transaction. Dont worry - it just means there is something BETTER out there for you- so stop wasting time on these people and go find it, I wish you all the luck!!!!

I agree. This sounds like a CO nightmare and you will not be able to close until it's all resolved; and that may take MONTHS.

I have to agree. The bathroom in the basement is going to cause major problems. The inspectors for the town will usually make the people ripe open the floor and walls so they can inspect the plumbing. The sellers had to have known that they were going to need CO's of all of that prior to selling the house. I would get out while you can. You don't want to be stuck in this contract for the next several amount of months.
