Applying for disability...

What is the deal on this. I called Dept. of labor and they told me that I have to apply after the baby is born. How the heck are you supposed to do that with a newborn?

I applied for it before the baby was born - with a doctor's note and it was submitted to my disability company by my doctor and then approved by the disability company a week later.

I was put on disability 3 weeks before my due date - which was later extended because i was 5 days late.

I believe if you are not put on disability before your due date you are expected to work till the day you are due.

Of course no one does and people usually take vacation or personal time - but i would difinitely speak with your doctor (especially if you are having some complications) and are near the end of your pregnancy and see if he will put you out on disability.

The doctors responsibility is just to send a letter requesting you not work to your disability company - it is your responsibilty to give him the company information.

It's just a form that you or your company fills out the majority of, then your doctor fills in a portion (mine did it at my 6 week checkup) and then I sent it in and got my 6 weeks disability in 1 lump sum. It really wasn't time consuming at all.

Most of our employees fill out the form prior and give it to HR to hold until their due date. IF you go early as I did, the forms were fedex'd to my house, which was a big pain in azz. The last thing I wanted to do with a baby in the hospital was to head to my ob/gyn to get them to fill it out.

Ask them to fill out the forms as soon as you can. No one expects to go early.

how do you know if you are eligible for disabilty?

I get 12 weeks FMLA. My comapany pays us for 2 weeks, and then will pay us out any accrued vacation time we have leftover. After all is said and done, I will be paid for 7 weeks. Can I get disability for the remainder?

I alerted my company's disability division of the expectation of my disability with all of my info and then I just called it when I had the baby...

As per NYS you are entitled to 6 weeks for a vaginal birth and 8 weeks for a c section PAID. If your Dr puts you out on disability you have to get a note from them and have the Dr and your work fill out the papers and the Dr office will mail them out. My office had it ready to go with a stamp on it and I brought it to my Dr and all they had to do was fill it out and mail it. Even if you have time from vacation or personal time the state doesnt need to know any of that you are still entitled to your $ up to 170(I believe) a week. So you could be getting $ from both your employer and the state at the same time.. Thats about itChat Icon

I brought my paper work to my doctors office after filling out my part and they now have mailed i in for me after having the baby.. I am getting 6 weeks..

My doctor put me on 2 weeks before my EDD. I faxed the papers through myself and received payment 10-13 days later......
