unemployment question

Can you collect if you were let go for supposed "insubordination"?
I get the feeling my boss is trying to do this to a co-worker and fight an unemployment claim. She is young and I am afraid she won't fight back.

Usually you can't get unemployment if you were fired in anyway unless you feel that it was an unfair firing and can somehow prove it.

This isn't true. You can get unemployment if you were fired so long as you weren't fired for willful misconduct, stealing, lying on your job application, etc. If you were fired b/c you weren't a "good fit" you can receive unemployment. Insubordination is most likely considered wilful misconduct, but the employee can still fight it and appeal the denial of benefits.

ETA: What did the employee supposedly do?

Employee's win more cases than you think. The state would rather give the employee unemployment rather than not. Because something like insubordination is not so black and white, your friend will most likely get unemployment. Thngs like stealing and unethical behavior are harder to win because alot of time they are cut-and-dry.

No, you can't. My dad was fired for insubordination, he worked there for 15 years, and they fought it so he couldn't collect one penny of unemployment.
