Another maternity leave topic
So- I work for a small company- less than 50 people- so the FMLA doesn't apply to me. I saved all my vacation/sick time- about 3 weeks- basically i'm going to work as long as I possibly can.
we are supposed to have a meeting this month about what she is offering me.
If she doesn't offer me any compensation at all, i sort of consider her laying me off... with that said- what is my recourse? I know for unemployment you need to be able to work- obviously the time right after the baby is born- i am NOT able to work.... so, can I draw off disability?
I sort of feel working for a small business no laws apply to me.

you should be able to collect 6-8 weeks of disability depending on the type of birth... then can you take your additional 3 weeks off that you've been saving then go back to work?

yes. i guess i'm sort of at the point where working in a company for 4 years that is only 3 people if she were to offer me nothing at all- i don't know if I want to work here anymore.

I'm in a similar situation and other than a few leftover vacation days for the year, all of my time off will be unpaid. It's kind of s@itty but that's how most business work. No short-term disability either.
ETA: I have been here for 6 years and one of their "key" employees and I'm not even guaranteed my position back!

why don't you have short term disability? I know my company contributes to the state disability fund- isn't that mandatory?

Nope, not covered by FMLA for 50 minus employees. I would be entitled to short-term if I had a c-section though.

I thought FMLA is just the bare minimum that states can offer as it is a federal program- NY State has disability- and from what I've read on the web and on the state websites- pregnancy is a short term disability and needs to be treated like any OTHER disability (breaking arm, leg, etc) so if employer contributes to state disability fund, you are eligible to collect out of that fund.

this is what i found on new york state website:
New York State requires all employers to provide: Unemployment, Workers’ Compensation, and Disability insurances as well as comply with wage reporting and withholding tax requirements. The NYS Department of Taxation and Finance’s Publication NYS-50, “Employer’s Guide to Unemployment Insurance, Wage Reporting, and Withholding Tax,” explains NYS tax responsibilities as an employer.
