Trees that are not on your property

does anyone know what the "rule" is?

Our neighbors have a tree, that hangs over our driveway and touches our roof. Are they responsible for the tree? Can we make them trim it? or is it our responsiblity?

WE had this, I don know what the rule is. But the tree trimmer said whatever is on our property can be cut.

So away we did....

We have the same problem with a neighbors pine tree overhanging our back deck, so DH cuts off its branches every summer. Otherwise, it leaves a mess on our deck if he doesn't.

You can cut the branches that extend onto your property. Unless you have permission, you cannot go onto your neighbor's property to cut the trees/branches b/c that's trespassing.

If your neighbor's tree has branches that extend onto your property, you have the legal right to cut those branches. Laws are different for trees that are healthy and ones that are diseased. If a tree is close to your property line, extends over, is healthy and either branches or the tree itself falls onto yourbecause of some natural occurrence property causing damage, the owner of the tree would only be responbile for the damage caused by the branches that were hanging over the property line. However, if the tree is obviously diseased and the owner does nothing to get rid of it and it falls causing you property damage, then the owner of the tree is responsible for all damages. Sometimes, a tree is diseased on the inside and looks perfectly healthy on the outside. In that case, the owner would not be responsible for any damage.

we called in a company to trim them, but I made sure we told our neighbors beforehand to make sure she was aware. Not to get her permission since we were paying for it, but just so that she knew.

You are allowed to cut trespassing limbs, but make sure whoever does it knows what they're doing. It has to be a "proper cut" meaning that if you cut to close to the trunk, you could do damage to the rest of the tree and that could get you in trouble.

We did the same thing. We're friendly with her and just told her to so she'd be aware. We just had this done Saturday!!! Chat Icon
