work laws

I am curious to know...a friend of mine got laid off for 1 month for work performance...is that realistic? Seems a bit harsh and cruel. Aside from that they were warned that if they didnt dot their I's and cross their T's they would be fired upon return. Seems pretty threatening to me. Is this allowed within the workforce? Totally curious? TIA

I think since it's an employment at will state, they are totally within their rights to do that, but it stinks that they didn't give her more of a chance!

ETA: I read the question wrong. She's laid off and can come abck after a month? That's just really weird.
Did she do something really wrong?

Do they have an Employee manual that states their policy for this?Warnings and concequences?

I am unsure if they have a work manual but I would think 4 weeks is a stretch. In my company Ive only seen people suspended for a day or 2 not for 4 weeks. Also wouldnt it be obvious this person would look elsewhere.

The one thing she should look into is if she gets paid a salary that shoudl be in her offer letter. If they are laying her off with no pay then that may be a breach of their contract. She can get unempl.oyment I think though. I would immediately start looking for another job though

Thats actually something I didnt think about. I wonder if she can get paid unemployment since technically it is like they are firing her for a month. Ive never heard of such a thing. If you suspend for a month then just fire.

I think that happens with cops all the time. A friend of mine works with a teacher who was accused of sexual misconduct and suspended without pay.

What did she do to warrant this though?

It sounds like she was given a 1 month suspension. If it was in her company's policy manual, then it should be completely legal - well, given that the circumstances warranted the suspension. As far as the warning of firing upon return, seems like she is on probation. I would use the month to look for a new job!

In my union, you can be suspended with out pay for one year. During that time you have to find employment elsewhere and prove 40 hours a week (via paystub) to the union for rehire after the year is up. If the person deserves it (you pretty much have to be a royal screw up) then they deserve it.

OMG...a year! Could u even imagine.
This person was audited by the state and there were multiple errors from multiple people. I think as a company they need to blame it on a few innocent people.
