I swear Rebecca, we are on the same page. I printed a bunch out yesterday to hand out to my family members. It is so important to fill one of these out and have a frank discussion with your loved ones about your wishes. Too many times emotion gets in the way of what needs to be done.

Be sure to fill out your instructions on this.
While I've made DH my health care proxy years ago, I stated the circumstances very specifically (Basically pull plug upon declaration by 2 independent drs of brain dead or coma...All life support, artificial nutrition & hydration ceased after a maximum of 6 months.). He said "I can't do that! People recover after 10 years in a coma." I responded "I know you can't. That's why I've decided - so you don't have to."
My specific instructions supercede his wishes.

Does this need to be noterized? As I understand it, this covers more ground legally than a living will or a DNR, correct?
My family knows my wishes, I've been very vocal, but I'm not sure that when the time comes they could actually do it.

No, it doesnt need to be notarized. But it needs to be signed by two witnesses that are not stated as either your agent or alternate agent.

While this is a good start, I really would urge everyone to look into a living will. They are legal, binding documents. A proxy may be looked at for state of mind, etc since they were not drawn up by a lawyer.

A living will is different then an Health Care Proxy...A HCP will allow another to make medical decisions for you like authorizing treatments, operations, etc. A living will is the document that allows someone to take you off life support or to ask for DNR orders that you requested be observed. They are different and you do need both in NYS.
If anyone has any questions, please feel free to FM. Part of what I do for a living is Estate Planning and Contigency Planning. I would be happy to answer any questions.
ETA: A living will lets you make the decision once you are incapacitated. Health care professional must abide by what your living will states. With a HCP, whoever you appointed makes the decision regardless of waht you may actually want. If they decide to keep you on life support, their decison is treated as if your own. That is the major difference between the two. I wasn't sure if I was clear in the above.

So what happens if I have both, name DH to make decisions through the HCP but in my living will state that I don't want to be on life support? Does his decision override mine? It's all so confusing.
