Am I eligible for disability???

Im working full-time right now, but I will be leaving about 2 weeks before my due date (but I will continue to receive pay checks for several more weeks due to left over vacation time). I wont be returning to work after I have the baby and I already informed work of this. Can I get disability??

I think it depends on when your company will say your separation of service started. I think if you have already been "declared"not working prior to having the baby or for any time during disability, you don't qualify. Check with HR.

You are eligible for disability if you have worked in the last 4 weeks. If you go out 2 weeks before you give birth you are still eligible.

I'm not sure if the fact that you will receive vacation pay alters your eligibility.

You can call NYS disability @ 1-800-353-3092

You still need a medical reason to receive disability prior to delivery (being 9mths pg isn't reason enough unfortunately). Once you deliver you will receive 6wks for a vaginal delivery and 8wks for a c/sect.

I did the same exact thing... I received my disability with no problem just make sure that they dont think you want to get disability prior to giving birth (that happened to me because I had predated documents).. once my doctor filled out additional paperwork I received my check within a week...

So is this disability different from the short term maternity of 6 weeks?

How do you do that? What is the disability?

I had called a while ago and was denied anything but the 6 week $170/week.

Sorry maybe I was unclear. You can't actually collect a check until you either give birth or your Dr.. puts you out but you are eligible once that happens. If you "choose" to not work over 4 weeks before you become "disabled" then you cannot collect disability.

If your doctor declares you disabled before you are to give birth then you are eligible for disability but you will only get $170 per wks if 50% OF your weekly pay is $340 OR MORE... and you are eligible for up to 26 wks or more then when you actually deliver its the 6 wks for vag birht or 8 wks for c-section. i just called to find out definetly for sure b/c my docotr is putting me out on disability so it will be a total of 7 wks prior to birth.
