ANNOYING SELLERS AGENT - LONG

Has anyone ever had to deal w/ anything like this?

Here's the deal:

Went to look at a house last week, Sellers Agent did not know the answer to any of the questions we asked, 100 amp electric ??, how old is roof??, nothing.

Went back to look at is again w/ Husband and our friend who is a contractor. Me and my friend were just walking around and my husband and the contractor were running all over the house pointing out little things to each other, nothing major. Sellers Agent was trying to listen to everything they were saying and writing everything down.

Put an offer in on the house last Friday w/ a binder and a $500 check to show how serious we were.

Engineers Inspection Tuesday morning, went fine, we should have the report by Today. While DH and Engineer were walking around Sellers Agent was up the A$$. DH actually had to tell him to leave them alone so they could talk.

Tuesday afternoon I get a phone call from Sellers Agent asking me what the next step was!!! I told him that we are waiting for the Engineers Report and we would have it in a few days and we would contact him then.

W/ in one hour I get a call from the Sellers Attorney stating that were taking the house "as is" and he is sending the contracts over. I told him to contact my attorney b/c I never said we were taking the house "as is".

Yesterday I received no less than 5 phone calls from the Sellers Agent asking me why getting the contracts signed was taking so long. So long it has been less than 1 week. He said the sooner the contracts are signed the better. Yeah better for him, think he wants to get paid or what!!!

Is it totally unreasonable for my attorney to have the contracts for at least a couple of days before we sign them?

It's a hurry up and wait game. It always is....everyone is so anxious to get everything signed and then you wait........for title....to clear title....to get a closing date.............to get it ajourned.................to schedule another...............


I think that what they did was wrong..Obviously, they are trying to get you to sign so you don't back out because they don't want for you to make any requests.

Hopefully things start to move along a little smoother.

Big advice.Have everyone deal with your attorney.

personally, i dont follow the buyers and inspector during inspections because i know they dont like it...they want a chance to discuss things. HOWEVER, there are a lot of agents that do because its their listing and want to be able to address any issues asap. so please dont be offended, maybe the seller wanted him/her to hear everything.

with regard to signing the contracts, realistically its in YOUR best interest to sign the contracts asap. the seller has the legal right to continue to show the house up until contracts are fully executed by both parties. so being that you paid for the inspection already, another couple may have gone in during the interim and placed an offer and ARENT going to do an inspection or try to negotiate. in which case, the seller would obviously go with the new offer and your out the $ you spent on your inspection. i should know because this EXACT same thing happened to one of my buyers last week. they took 4 days just to TALK to their attorney about the issues in the house and in the meantime the seller got another offer and signed the contracts asap. i would hate for that to happen to you.

being that its thursday and you had the inspection on tuesday and they were already calling you asap, yes they were rushing a little bit. he should've at least waited until wednesday to ask you what you were planning on doing. have your attorney call the sellers attorney and address the issues asap.

This sounds exactly like the agent we dealt with. He doesn't happen to work for Century 21 does he? I found myself telling him how things worked. It was very annoying.

I can totally understand your frustration. Unfortunetly, this is an exact example of why the real estate industry gets a bad name. I personally can't stand when realtors walk around with you, especially at the inspection stage. Now personally as far as contracts getting signed, there shouldn't be communication between you and the seller's agent, it should be between attorney to attorney.

it can definitely be annoying!

but sometimes too, the attorneys have a lot going on and although it is first and foremost in your mind, it is not in the attorney's mind. so sometimes they need a little prodding, and maybe the REA has had experiences in the past where deals fell through because of inaction on the attorney's part and just wants to make sure things are moving along.

Exactly.

I told him that if I come back to my desk at work and have one more voicemail from him he is going to see my not so nice side. Up to this point I have been very patient with him and believe me I am one of the most impatient people on the face of the planet.

It really is uncanny how much this guy sounds like the RE agent we just dealt with. Scary enough, i knew it wasn't this guy's first sale.

I just had the Engineer fax me over the report so I could get my attorney to look at it ASAP, I work in the same office as my attorney.

I called the Sellers Agent to tell him that I received the Engineers Report and that maybe I can get the contracts signed to him by tomorrow.

Now he is telling me that he has alot of agents calling him to show the house and the sooner we get the contracts signed the better.

Do you think he is lying just to get me to move faster than the lightning pace we are at now?

Keep in mind we only had the offer accepted last Friday.

It is quite possible that he is lying to you to get you to sign the contracts asap. Our guy did the same thing. He was calling me the whole weekend after our attorney received the contracts wanting to know when we were going to sign. He even offered to drive to Brooklyn to pick them up from our attorney and bring them to the sellers attorney. We told him, no thanks and that we were moving as quickly as humanly possible.

Luckily once the contracts were signed and our mortgage was approved we didn't hear from him much until the week before we closed.

Most REAs will put the pressure on to sign, esp. if it seems as if there may be a hitch. Though your agent sounds very pushy. You should wait and get the issues you are concerned about straightened out though.

It is true that you run the risk of losing the house the longer it takes. If the buyer's get another offer that sounds more appealing, they may take it. It's not fair, but they could do it. So if you really love the house, you should push your attorney to get your concerns addressed quickly.

Unfortunately you never know if the agent is lying about having other people want to see the house. Some of them use this as a tactic to get you to sign the contracts sooner, and some are telling the truth.

If you are doing things in a timely fashion (which it seems that you are) then everything should be ok. I have had buyers where they couldn't even get there attorneys on the phone for TWO WEEKS. That is unacceptable. But when you are working on it, and so is your attorney everyone can only move so fast. I would try and schedule some time with your attorney to sign the contracts though because their schedules fill up fast - you can then tell the agent "I am meeting with my attorney on this day, now leave me alone until then"

I have known plenty of attorneys who have killed deals (not on purpose but because they did not work in a timely fashion)

Good luck - I'm sure everything will be fine.

ETA: Before I became a REA and I bought my house - my agent never told me that the sellers could still show the house until contracts were signed. I was taking my sweet azz time to get to my attorney because I was thinking "Great, the house is mine, now I can save more money" -- If I were to lose this house I would have been pizzed!!!!

Thanks everyone for all your advice.

I just got off the phone w/ the Sellers Agent again and told him that the contract would be signed on Monday.

I just got the Engineers Report this morning and went through the entire 30 page report and marked the $hit up out of it.

I told him that we are moving as fast as possible and I also reminded him that alot of what is in the engineers report we are not taking issue with b/c we are replacing alot of it and I also reminded him that I am not dealing w/ a buyers agent on my behalf and he is saving some of his commission that way.Chat Icon
