Any attorneys that deal w/ employment issues (on the side of the employee) here?

Looking for information on possibly filing an unfair dismissal complaint against an employer. I am not the possible filer; a friend asked me and since I'm a law librarian she thought I'd know but I don't deal with employment issues. I've done some research and I know there's the NLRB and the EEOC but I'm not sure which one would be the one to contact for her, or if she should talk to an attorney first. If anyone has experience w/ this or any empl. attorneys out there please FM me to let me know the best way for my friend to proceed. Thanks.

I would file at the NY State Human Rights Division and the EEOC, if there is any overlap. Tell your friend there are STRICT time requirements for filing a complaint so if he/she wants to file, he/she must do so within the timeframes allowed. Remember, too, the unfair dismissal must somehow be related to a right that is protected by the state/government - i.e. race, religion, sex, national origin, disability, etc. The only reason why I say that is most of the people who call me to file complaints have been dismissed, albeit unfairly, but do not fall within one of those classes... and thus, have no rights under the law.
