Anyone ever use a Workman's Comp Lawyer - I have questions.
We're at the point that DH really needs to get a workman's comp lawyer. As far as people have told us, you don't have to pay them - they just take a percentage of your settlement. My questions - what if you don't get ANY settlement - do you have to pay? Also, what is the average or normal percentage for the lawyer to take? DH got a recommendation for someone and the lawyer takes a third of your settlement - that seemed high to me - is that normal?
Also - if anyone has any recommendations in Nassau - would be greatly appreciated!!

Hi Michal..1/3 is normal. My mom has a case going no and that is standard. I'll see if I can get her lawyers info, he is excellent, DH and I have used him in the past..

1/3 is completely normal. The case will most likely settle, but if it doesn't and you don't get awarded anything, you owe nothing. The lawyer takes the risk of doing the work and not getting paid, which is why he or she gets paid 1/3 when the case settles or you win at trial. The lawyer probably won't take the case if he or she doesn't think you will get any $ either through trial or settlement.

1/3 is the norm. My firm usually takes 33 and 1/3... it does seem high, but the reason is that the firm is taking the entire risk if you don't win anything. If you don't win, you don't owe a penny and the firm ends up losing a lot of money and time. We just had something like that happen to us - we ended up spending about $30k in time and miscellaneous expenses for a case that we didn't win. No burden on the client, but a serious burden on us...
