Anyone familiar with landlord/tenant rules in NY?
I cannot find much on the info except for HUD and subsidized housing stuff.
I need to know if a landlord is allowed to come to the place you are renting at any time they want? Even if you are not there? Or be in your yard when you do not know, etc. I understand you are paying rent, but what kind of privacy laws are set?
Also, the lease has virtually no clauses--it is a piece of paper hat says so and so are renting from so and so for this period of time. Thats it.
So the landlord b!tching about things, does he really have a leg to stand on? No clauses say anything about anything being touched, damaged, etc...(drilling hole for wires, installing dishwasher, etc)

A landlord can come in ANYTIME he/she wants. WITH/OUT YOUR permssion. I believe the need to ler you know they were there.

I always thought they weren't allowed in your apartment with out your permission. But I don't know for sure. Sorry

They are allowed to enter if they feel like they need to make an emergency repair.

No No No, they are not allowed to just go into your apartment whenever you want when your there or not, generally its 24 hours notice (im in manhattan)
The only time they could enter when you are not home is if there is an emergency ie leak, fire, etc

A landlord cannot just enter without a reason.
RIGHT TO PRIVACY Tenants have the right to privacy within their apartments. A landlord, however, may enter a tenant’s apartment with reasonable prior notice, and at a reasonable time: (a) to provide necessary or agreed upon repairs or services; (b) in accordance with the lease; or (c) to show the apartment to prospective purchasers or tenants. In an emergency, such as a fire, the landlord may enter the apartment without the tenant’s consent. A landlord may not abuse this limited right of entry or use it to harass a tenant. Additionally, a landlord may not interfere with the installation of cable televison facilities. Public Service Law § 228.

ETA: If your lease does not specifically state you have yard privileges, then your landlord can be in "his" yard anytime he wants. An oral agreement cannot alter a written agreement which is why you should have everything in writing.

Do a google search for New York and covenent of quiet enjoyment, and check the lease and consider consulting with a landlord-tenant attorney.

thanks everyone! Its for a family member--their landlord is steping over the line....
and their lease metnions nothing about anything...they are starting to feel very uncomfortable ther & would like to break the "lease" and get out of there
They ahve had to file somethingw tih the PD and are now documenting EVERYTHING
just sucks!

Are they month to month? You said that their "lease" didnt mention much. If it does not have a time period then they are month to month tenants and all they have to do is give one month notice.

My parents are landlords..own a 3 family home. They NEVER go in when no one is there. Infact, i thought they said they were legally not allowed to.
If work needs to be done my parents always ask if someone will be home, and if not, they inform them that they will be there whatever time when tennants are not around. But they usually make it a point to do things when someone is in the apartment.
