Anyone know about Unemployment?
We received a "Notice of Potential Charges" today for an employee that hasn't worked for my hubby since June 07. Between June and Dec 31 he had a job at a restaurant... since he had other employment are we still required to pay for his unemployment??

I think NYS goes back 6 months to verify employment & wages. Since he left your DHs company at just about that time, they are checking for any income that may fall into that period.

Ok, so for the last 6 months if he was working for someone else they are going to have to pay the bulk of the unemployment correct? Do we have a way of fighting it because DH could use him to work now and he just doesn't want to?

If you tell the dept of labor that you have an opening for him, they will go back to him and let him know. I would call him first. He may be working off the books somewhere and wants to collect unemployment as well.

ok, so maybe that's it. I wouldn't want to work in the cold. Was he a good employee? In the warmer months was he a good employee? Will your DH use him again? Then maybe, it's just hard to get people to work in the cold.
I don't know...one side of me says tough and the other says I wouldn't want to work in the cold either.

Yes, he's a good employee and my DH is great to work for. I know no one likes being out in the cold 8 hours a day.. or the hot in the summer... He was working at the restaurant the whole time while working for DH as well... the restaurant was weekends and DH was during the week.

If DH has a job opening for the guy, than he should tell the DOL that. If the guy doesnt' want to work, that's his call - but you shouldnt' have to pay unemployment for someone that doesn't want to work for you.

I agree 100%.
DH had a similar situation with a few employees too. You have to do what you have to do.

my dh once had a guy that only worked for us for a couple of months. his attendance was poor then suddenly he didn't come to work & we didn't hear from him. his father called on payday to ask for his check & told me "peter turned himself in, he had a warrant. He'll be out in a few months " i send the paycheck, note everything including dates & my conversation with his father in his employee folder & months later i get the form fromunemployment. I copy my record, fill out the whole form with the story & here back from them that we had to pay the bulk of his UI while HE WAS IN JAIL. basically unless an employee kills someone they qualify.

I was always under this impression as well, but it is not really the case. This person was employed by the carpenters union for a year or so before he starting working for us. The paid a portion but considering the short time we employed him, we got screwed. ETA-since 9/11 some of the guidelines were changed in an effort to help those displaced by the attacks. It is my understanding that things are still in favor of the employee even if they were not directly affected by 9/11.
