Breaking an apartment lease question
Has anyone done this? DH and I originally signed a two year lease but it looks like our house will be ready two months before the end of lease. Not a huge problem if they don't let us out because it is only two months but I am trying to figure out how I should approach this. Now we live in an apartment complex and not a private home. We also know someone who wants to move in to the apartment when we move out. Thanks for any input

I would check your lease to see what it says about terminating the lease early. They may not make a big deal if they are able to rent it out those two months.
I would send a letter certified mail/return receipt to the building manager expressing your desire to terminate the lease early. I would go to that you would be willing to accomodate them in making your apt available for potential renters and that you already have someone interested and ask for the contact person for your friend to call.

You're responsible for the rent until the lease is up, but the landlord is required to make an effort to re-rent the apartment. If someone else rents the apartment before your lease expires, your obligation to pay rent ceases when the new tenant's lease period begins.

Thanks for the input. Now I am thinking of seeing if the management company will do a sublease. I think they probably will so that could be another option.

I told my landlord that I was buying a house. He let me out of my lease 4 months early.

Are you sure about this ? I broke a lease last year in a Suffolk apt complex and was forced to pay a fee of 1 months rent. Even though I'm fairly certain the complex was able to rent out my apt immediately, I don't think there was any way around this since it was specifically stated in the lease that this would be the penalty if I terminated early. I would check the wording in your lease.

If you have someone to rent it right away, they cannot make you pay the rent.

Perhaps they can't make you pay the "rent" however if the contract/lease indicates that the renter will incur a fee upon early termination of a lease, I think there's no way to get out of paying that "fee"..regardless of whether or not you or the owner are able to have someone immediately move into the apartment after you leave.
