calling all maternity leave experts
So, I finally got my maternity leave policy in plain English from HR yesterday...some background, my company is based out of Cali, there are only two of us in NY... Anyway, the company as a whole does not qualify for FMLA bc they have less that 75 employees in a 50 mile radius or vice versa.... What I am getting is UP TO 4 months of disablity, I think they are extending what Cali laws allow them to me...But my HR woman is having a hard time finding what that means really, meaning how much I'm entitled to get a week....and its up to my doctor to keep me out on disability????? How does that work...anyone that can shed some light on this it would be really helpful, bc unfortunately my HR woman hasn't dealt wtih anyone in NY being pregnant except or me, so I'm the first guinea pig....

Well...I can tell you that you are entitled to NYS disability which is 6 weeks for a "regular" delivery and 8 weeks for a c-section. NYS pays up to $34 during your disability but if your employer is paying you they will most likely receive that payment.
Because you don't qualify for FMLA and since your company's policy does not seem to be in writing I think outside of the state disability you're just going to have to go with what they tell you. I'd keep on the HR person to find out what the policy means for you. I mean it's not like they only have a day to figure it out!
I'm sorry....it's a strange situation you are in.

see it is in writing, but its in writing based on Cali law...so I'm just really confused, bc not sure how they're extending Cali law to me, but paying me NY disability rates....weird!!!!

i work for a large company and we are based out of LI, so i dont have much advise. But like the AP said, keep on the HR person to find out what you are entitled to, and talk to your DR at the next appt.

HMMMM so it sounds like you will only be paid for 6 weeks vag birth and 8 weeks section, but can have the 4 months off without pay after the NYS disp is over..... I would just keep bugging them for a clear answer

See thats what I thought, but I think shes qualifying it as short term disability and being entitled to what someone on medical disablity would get regardles... UGH...so freaking confusing...

It is really confusing and without some good guidance from your HR folks your really left up in there air. We are based in Philly but have offices in CA. I'm based in NY. We all have our specfic state programs but follow a Firm wide program for disability. It's only FMLA where we differ (DC and CA have longer FMLA periods).
I'm sorry I can't be of more help. Your HR folks really have to tell you how they are going to treat your leave. You'd think because there are so few of you in NY they'd just lump you into the CA policy.

ive been getting short term disability since may 28th because of my car accident..i found out yesterday, that even if my obgyn puts me out (for pregnancy related issues, which i DO have)..with a different diagnoses, i will NOT be covered past the 26 weeks everyone in nys is eligible for in a 52 week period.. anyway, to answer a question you may have...nys disability maxes out at like 160 a week or something RIDICULOUS. Thankfully i have aflac in addition, which is based on ym salary and pays a hell of alot more...do you have another disability plan?
