Changing a child's name

Does anyone know if I can legally change my son's last name to my married name without my husband adopting him?
(he's his step dad)

I beleive you do,they do it to protect both parents right.
Imagine if he changed it with out you knowing.

if your childs bio-father is listed on his birth certificate or if he has any type of custody or vistation you need his permission.
A very close family member changed a child's name, they hired an attorney, the attorney placed public notice in a local paper and a few weeks later it was done.

Is his bio dad on the birth certificate? Is his last name your last name or biodads?

his name is on the BC... My last name... he has not been involved since DS was about 2... but he DOES pay child support (well HE doesn't, but I get it... it's a tough situation to explain)

if you have no way of contacting him I believe it can still be done be using the public notices in newspapers. Maybe one of our lovely LIF attorneys can help you

OK dont quote me on this...b/c Im not sure how New York specifically does this type of thing...

But yes you can. He doesnt really even have to give his consent. There will be a court date and the judge will decide what is in the best interest of the child. Being that he isnt involved Im sure they will allow you to change it....and he'll still have to pay child support...

I would rather not have to get in contact with "him"... cross your fingers!

another thing.. Do you think I'll lose my child support? Its not much, but we're pretty much dependent on it for child care right now... I know my son really wants to have the same last name as his step dad... so I'll give up the CS if I have to..

Changing a name doesn't make the bio dad not the bio dad anymore so he still has to pay support unless his rights were terminated. Chat Icon
