Check out what my job called and told me....
Basically, they asked if I can come back to work in a week...I'm due back the end of January, After my baby turns 3 months and the nanny can begin work. I told them I'm not able to, sorry. They said that since my group is very busy they might need to hire a perm person and when I come back that they will have another job in another group for me!!! ***!!!!
I'm not covered under FMLA, so I'm not sure if they can do that! I'm so p*ssed off right now!
Plus I called my coworkers and they told me they have work, but it's not that bad!
HR will call me if they decide to do that. I don't know what to do!!!

Unfortunately, if you're not covered under FMLA, your job isn't protected. Your employer can transfer you to a different position. I'm sorry you have to deal with this.

If you are not covered under FMLA they don't have to hold a job for you at all.
If you are covered under FMLA they have to hold a job for you, not necessarily your job.
It sux, I didn't have FMLA and in spite of being told for months before I went out that they'd hold a job for me, I found out after 3 weeks there wasn't one. We got a new VP and since she didn't know me she didn't care. I'd already decided to be a SAHM anyway.

They can do that, even under FMLA. FMLA just says they need to keep you in the same level position, but if the company's needs dictate they backfill your job they can move you laterally as needed. Without FMLA they don't have to keep your job for you.
