If my kid EVER got out of his/her seat belt trying to get something I wouldn't keep going, my car would be pulled to the side and the kid would be yelled at. I hate frivolous lawsuits!!

Yea, as much as the woman shouldn't have been put through all that drunk driving stuff....I would hope that I would never get to the point when my child gets out of the seat and I keep going...
She could have simply given him the happy meal toy right away....instead of keeping it up front with her.
Or stopped when the kid took off his belt!

Well, when I was little I opened the car door while my dad was driving. I didn't fall out because I had my seat belt on. My parents were so angry. I do see how kids can do crazy things, and based on this story I don't think the woman was at fault for her actions. Her child did something he was not to do.

Okay, my sister has MS and has been in a similar situation where someone thought she was impaired and gave her a hard time about driving.
She explained to them that she has MS and her left leg sometimes doesn't respond the way it should and they continued to ride her and threatened to call the police until she reached into the car and showed them the handicap tag.
It's one of those diseases that isn't always obvious to the naked eye and people misinterpret it all the time. So I am a little outraged about how the mom was treated in this situation.
HOWEVER, the mother did mishandle the child in the first place, but we can't say for sure if she had a place that she could pull over. It's just sounds like unfortunate timing for the mom and the kid and a case of misunderstanding for the cop and the witness.

I have mixed feelings about this. First, I don't understand why the doors weren't locked when there's a child in the car. Second, why would she not drive her son to the hospital immediately and just have the niece meet them at the hospital? Finally, if the woman claims she has MS and can't pass a field sobriety test, why didn't the officer give her a breathalizer to see if she was telling the truth? I think the officer could've handled the situation better, but I don't think he or the police department should be sued.

I agree with everything that was stated above. I have mixed feelings about the whole situation....
1) There are child locks on car doors...what happened there?
2) Did she have handicap plates or a tag that could've prevented the ordeal with the police?
3) Why would you NOT call the ambulance...your child just fell out of a car...whether it's moving or not....it's still dangerous.
