Court Date Looms for Chris Brown *UPDATE BELOW*

Almost a month after Rihanna was allegedly assaulted in a domestic violence case, Chris Brown has yet to be formally charged with any crime by prosecutors.

But he does have a standing court date Thursday in Los Angeles, and may be required to personally appear at the arraignment depending on whether the District Attorney's Office files a case against him.

Or not. The court date could be delayed pending more review: The DA could take more time to mull over the evidence or hand the case to the City Attorney for less serious charges.

Brown, 19, was arrested Feb. 8 after an alleged altercation with Rihanna, 21, in Los Angeles the morning before the Grammy Awards. Police booked him on a felony criminal threat charge, set an arraignment for Thursday, and launched an investigation.

Among the possible scenarios Thursday:

• The DA could charge him with any number of felonies, among them, domestic violence and making criminal threats, each carrying a maximum three years in state prison. They could also file a combination of felonies and misdemeanors.

• If charged with a felony, Brown will be required to personally show in court and could enter a plea.

• If the DA doesn't file a case against him Thursday, Brown will not be required to show, and would be notified to return to court at a later date.

• The DA could decline to file formal charges, and refer the case to the City Attorney's office for misdemeanor review, which could take days or weeks.

Even if Rihanna refuses to cooperate with prosecutors, the L.A. County District Attorney may have evidence even more powerful than the gruesome photos. Multiple law enforcement sources tell TMZ, the night of the attack Rihanna told cops she was the victim of escalating violence -- and the perp was Brown.


LAPD cops interviewed Rihanna after the attack and she told them Brown had been violent toward her in the past and that the attacks were getting "more violent" as time went on. The interview is potent evidence if the L.A. County D.A. charges Brown with felony domestic battery, and that could happen as early as today.

And there's something else. The photo that TMZ obtained showing Rihanna battered, bloody and bruised is mild compared to other photos. We've learned additional pics were taken on February 9, the day after the attack, and they are far more gruesome -- the bruises and swelling far more pronounced. We're told these photos show injuries that could be devastating in a case against Brown.

Wow, I am not even surprised, that is probably why she stays with him, because is so scared of him.

I honestly don't think he will get charged, of he does, he will probably end up doing community service or something.

If they have all this evidence against him and don't charge him, than they would be doing more harm to domestic violance victims than Rhianna is by going back to him. Did that make any sense?

I think she's really scared of him, if its been going on and just getting worse....I really wish she had some good people around her to help her get out of this, or convince her to go to counseling....once she is in counseling maybe she'll realize how this isn't right!

Shocking Blow-By-Blow - Chris Brown/Rihanna

Shocking new evidence about what happened in the car the night Chris Brown allegedly beat Rihanna.

FOX 11 in L.A. obtained LAPD detectives notes from a search warrant in the case. According to the notes, Rihanna read a three-page text message on Brown's phone from a woman. An argument ensued and Brown allegedly tried forcing Rihanna out of the car but couldn't because she was wearing her seat belt.

Brown then allegedly shoved Rihanna's head against the passenger window. When Rihanna turned to face him, Brown punched her, then continued punching her while driving, according to the detective's notes.

Blood spattered all over Rihanna's clothing and in the interior of the car. Her mouth was filled with blood.

Brown allegedly told Rihanna, "I'm going to beat the **** out of you when we get home. You wait and see."

Rihanna called her assistant and left a message saying, "I am on my way home. Make sure the cops are there when I get there."

Brown then replied, "You just did the stupidest thing ever. I'm going to kill you."

According to the report, Brown continued to punch Rihanna, bit her on her ear, her fingers and put her in a headlock -- she almost lost consciousness.

Chris Brown Charged with Two Felonies

The L.A. County District Attorney has just charged Chris Brown with felony assault and making criminal threats, also a felony.


The charging documents name "Robyn F." as the alleged victim.

Brown will be arraigned today at 3:30 PM in downtown LA.

A spokesperson for the D.A. tells TMZ he could face a maximum of four years and eight months in prison.

GOOD! Now lets hope he does jail time!
I just read the affidavit from the assault and if he doesn't serve some time...there is seriously something wrong with our justice system

I hope the case doesn't hinge on her testimony.

I also hope if she recants, that they find out the SOB called her & throw an additional tampering with the witness (if that's an actual charge not a Law & Order charge)
