Disability and not returning to work
If you are let go or resign 1/2 way through your disability leave, do you lose the rest of your disability $ or do you have to pay it back?

Are you resigning during the 6/8 wk disability or do you mean after that when you are in unpaid FMLA?

DH & I decided that I am going to become a PTWM when its time to return to work (after the 6/8 wk leave). I'm not sure if my boss will allow me to have that type of schedule. I plan on having this discussion w/him during my leave.
So lets say I go in at my 4 wk mark and he says that this is not an option for me and I am forced to resign or they let me go, will I have to 1)pay back the 4 wks of disability I got so far and or 2) will I not get the additional 2-4 wks left of disability?

Disability and not returning to work
Honestly it depends on how the policy is written. If they have salary continuation set up during your 6/8 week leave you may have to pay that back. If it's through the insurance carrier (like Cigna) you should be ok up until your termination date. If your employer decides to terminate you and you have 2 weeks left on your leave or if your resign at that point you wouldn't be eligible for the remaining money.

Im wondering the same thing! I get the disability checks through an insurance carrier. I really hope I would not have to pay it back !
