Discussing maternity leave w/ boss?
so i will be spending fri morning with my boss as she will be acclimating me to a new school i will be working at. I work contract for her (i am paid hourly) and would like to talk to her about maternity leave as me and my DH would like to start trying in the spring. B/c i am contract emplyee, i know i wont be paid for it, but I just want to make sure that if i take off three months after having the next baby, that she will hold my position. Should i do it now, in person as i almost never see her (we communicate by email most of the time -infact, this will be the first time i have seen her in 2 years and only the 2nd time actually meeting her). Or do i wait till its closer to the time and call her and talk to her over the phone?
Last time i went out on maternity leave, i didnt want to come back right away in sept when school started (i had my DS the end school of june and it wouldn't have been enough time home with him), and she wouldn't hold my original job till November (when i wanted to come back). I lucked out that someone quit when i was ready to come back, so i ended up filling a new spot at that time. I just dont want to take that chance again (which is why ideally i would like a dec/jan baby so i can start in sept of that year, take off the three months maternity leave and go back in april to finish out the rest year, but again i am hoping she ill hold it for the three months i am out) and would like to know my options before i get pregnant. TIA!

Well i would talk to her once you ARE pregnant that way you'll have a round about month in which you are due.
If you work full time I thought it was illegal not to give you your job back if your out on maternity leave, so i don't understand how she couldnt hold your job.

i work part time, (and get paid hourly) so i wasn't sure if she was still legally binded to atleast give me there months maternity (since i am not full time). Also i work in NJ so i a not sure if its different form NY. Does anybody know?

If I am notmistaken, since you are a contract worker she is not legally required to hold your job. I believe the law is only for actual employees.
FMLA (Family Medical Leave Act) that requires employers to hold your job for 3 months is only for "employees" of companies that have 50 or more employees.
I may be wrong but you can do a search on FLMA to get more info.
