Read this!

It even says that selling your old toys on Ebay or craigslist will be illegal!

I read about it on the Mom 101 blog. I signed the petition. I am concerned because we buy handmade wooden toys from a small company in Wisconsin and this would definitely affect them.

Honestly, while I feel for small businesses that may be affected, I do think something needs to be done about this problem. There are way too many dangerous toys out there, I get recall notices every week, though so far, none have been DSs toys.

Most small businesses buy from toy wholesalers anyway, so there could be a provision for the wholesaler to perform testing, which would make more sense.

According to an editorial in the Patriot-Ledger, the legislation is retroactive. "This means that everything on the shelves in those big (or small) stores will also be 'banned, hazardous substances' – contraband…This also means that after that date, even selling your kids' old things on eBay or Craigslist will be illegal. Charities will not be able to accept donations without a certificate of compliance either."

The editorial is wrong. Before I posted I read the entire legislation. Every single thing I read says 180 days from August 14, 2008. That is prospective not retroactive.

hate to say it, but I agree with the most of the legislation. I dont trust handmade toys. many are wood made with toxic varnishes and paints. while the artisans mean well, most are not educated enough to know which chemicals are ok to use and which are not. and then our kids chew on the toys...

they should make a provision for that very small group of artisan toy makers that as long as they restrict their finishings to a pre-approved list, the toys don't need certification

I am also suspicious of the use of artisan toy manufacturers as the posterchildren for the opposition of this legislation... how much you want to bet it's mattel behind the opposition, hiding behind a picture of s grandpa puzzle maker as their excuse

I am looking into this further and I am all for the safety of our children, I just think the government has not gotten this quite right.
ETA it also is not just about toys, it includes infant clothing etc
