drinks for wedding at non-licensed restaurant
Hope someone here can help my sister! We've been Google-ing and can't seem to find an answer and need some contingency plans:
My sister is getting married in October at a restaurant that told her way back when (about 9 months ago) they were applying for a liquor license and upon approval, she'd be able to have an open bar. Recently, we checked in with the manager and they still have NOT gotten their license yet. I know the process can take awhile, but what are her options if they don't get their license in time for the wedding?
Legally, can she hire an outside bartender/caterer who IS licensed to serve alcohol in a non-licensed restaurant?
The managers will not allow her to BYOB (we were thinking we might do some bottles of wine on the tables for guests) since BOYB can jeopardize their application for a license, but what if the bottles of wine were the party favors?
Any suggestions or legal knowledge of liquor laws would be greatly appreciated!
At this point, my sister says it's too late for her to find a new venue since the invites have been printed and sent out and she'd really like to not have a dry wedding.

I am pretty sure that you cannot consume alcohol at a restaurant without a license - but October is still a ways away!

Definitely not true, as there are restaurants without liquor licenses that are BYOB. I just don't know how this situation would work. I would contact a private bar company and ask them directly.

This depends on your state.
NY you cannot BYOB unless the establishment has a liquore license, even of they are waiting for approval
NJ you can BYOB, to an establishment with no license.

I had no idea that was illegal. I have been to several restaurants in NYS that allowed that while they were waiting for their license.

BYOB, or “Bring Your Own Bottle,” where owners of establishments allow their customers to bring alcoholic beverages to their premises to be consumed on site, is NOT PERMITTED in unlicensed businesses in New York State. You MUST have a license or permit to sell/serve beer, wine or liquor to the public. Venues without a license or permit may not allow patrons to “bring their own” alcoholic beverages for consumption. In addition, owners of businesses may not give away alcoholic beverages to their patrons. Those that do are in violation of the NYS Alcoholic Beverage Control Law.
Applicants should be aware that allowing BYOB without a license may jeopardize their chances for approval of their license.

If I do not have a license, can I get a permit to serve alcoholic beverages at a function or event? You have two options for getting a permit:
Option 1: You can apply for a Temporary Beer & Wine Permit (aka: TPA); however, you cannot serve liquor under the restrictions of this permit. The fee for a TPA is $36 per bar/day. Option 2: You can hire a licensed caterer to provide the food and alcohol at the event.
So, according to the NY Liquor Authority, a licensed caterer CAN provide alcohol at an event if the facility doesn't have a permit.
