Dear All,

This message pertains to employees covered under the District's Empire Plan from 1994-2009 and the option you may have to file a monetary claim as the result of a class action lawsuit on your behalf.

In May, 2010 Empire Plan enrollees were sent notice of a settlement between the American Medical Association (AMA) and UnitedHealthcare (UHC) concerning Empire Plan members who received out-of-network medical services between March 15, 1994 and November 18, 2009.

This nationwide settlement agreement resolves class action litigation filed on behalf of the AMA, health plan members, health care providers concerning UHC reimbursement of out-of-network services.

All questions should be directed to Berdon Claims Administration LLC which is responsible for administering the settlement.

If you opt to participate you need to file a claim form as a subscriber. The claim form options and explanation can be found by visiting the website.

When completing the claim form subscribers have two choices; the first is simple (Group A) and the second requires providing more detail (Group B). If you are filing, the form must be sent FIRST CLASS MAIL AND POSTMARKED NO LATER THAN OCTOBER 5, 2010. The mailing address is listed on page 6 of the booklet that can be printed out by visiting the website.

Group A - Simplified Claim Form for Subscribers. If you elect Group A on the claim form, you will be requesting a payment of $50.00 for each year or part of the year in which you participated in the plan from March 1994 through November 2009. If you elect this option complete the subscriber portion at the to of page 10, check the box at the top left of page 11 and don't forget to enter the number of membership years at the end of the first paragraph, and finally complete the top half of page 15 remembering to sign your name.


Group B - Out of Pocket Subscriber Claimants. If you had substantial out of pocket expenses in one or more of the covered years you may be able to collect more by listing yourself as Group B subscriber (you cannot elect both A and B options). You will need to provide a detailed worksheets that begin on page 11 of the form and continue at the end of the packet. Group B subscribers who receive adjusted bills from out of network providers may also elect to participate under Group C.

I believe you have nothing to lose by completing this claim form. Just keep in mind that this must be completed and mailed by October 5, 2010....
