Finally got DH to agree to leave Josh to my parents as guardians..
who do I go to for a will? Probably simple question..looking for a cheap way to have it done. tia!

I got the Will Maker software and will use that. You can call any local attorney as well Make sure you have a 2nd guardian chosen and written in the Will in the event anything happens to your parents.

thanks! we actually have the software..do I get it notarized after that or anything to make it "official"?
sadly enough..I am worried that people will want to get to "Josh's money" then actually get to Josh.
great advice to get a second set.

If there are very large life insurance policies involved, you may need to hire a lawyer to set up a trust... something to keep in mind. The software is only good for the most basic situations and where there is unlikely to be disagreements.

Ugh! We never even thought of this. It was hard enough picking the 1st guardian. It's just such a big decision.

thanks! maybe I will start out with the software, then go to a lawyer.

OMG, DH and I had this conversation when we found out we were pg. We too are leaving Giada with my mom. We are having a lawyer do this b/c we want to make sure its official b/c she will have a lot of $$ and we too want to make sure she is in the right hands. the second guardian most likely will be my father and stepmom and after that not sure. We are giving her 3 guardians.
its something to really think about b/c unfortunately if you have family members who are and I hate to say this money hungry they may find something like this as an opportunity.

I work in a Law Office and we typically charge $150 to do a Will. It's worth it to know that you are doing it right by going to a lawyer (IMO).

That's extremely inexpensive from what I've seen. I think our attorney charged the union $350 & that was a basic will.
I agree - you need a second guardian, but also the person in charge of your estate's finances shouldn't be the same as the guardian as a rule of thumb.

Between Dh and I, we only have one complete set of grandparents and they are our first choice. Do people use very close friends or brother and sister IL or...?

I used my old sister as the first guardian and my younger sister as the second. You don't need to have a "couple" for your guardian(s) just so you know.

We used my older sister as guardian, second is my SIL Actually you don't name the couple as guardians, just the individual. That curtails legal issues in the event of a divorce/death with the couple, ie, if you name your brother & SIL and your brother passes away or they get divorced, your SIL could sue for custoday/get child support. Naming only your brother, prevents that from happening.

I think you should use a lawyer, IMHO. We will be. A lot of loopholes, supposedly, around the home law kits.

You should also know that when you get that Will done, do not keep the original in a safety deposit box, as a Court Order would be needed to access the box if something should happen to you.
