FMLA & Returning to Work Question-My boss is a @#$$!!!!-Update 7/13
I had many conversations with my boss before I left on Leave regarding my FMLA timing and returning to work.
I was on partial bedrest so some of my FMLA was exhausted before my leave. I went out on bedrest in February, and we secured daycare in January. IN CT we get 16 weeks FMLA and I used 5 weeks by being on bedrest.
The earliest date i could get at a daycare center I liked was September enrollment and that was from january!
SHE KNEW all this! Now all since my FMLA is expiring on 7/21, she isn't sure if my company can accomodate a september return. There is no way I can get Gianna in daycare earlier than that, I already tried. This company is back azz backwards sometimes and my boss is the most inconsistent person you will ever meet. She is one of those bosses that promises you the world then backs down and claims she didn't say any of that.
My question is Anyone know what they can do to me? Can they fire me? Can they tell me come back in a week or else? Does anyone know what I can do?

I may be wrong, but I don't think they have to hold your job after 7/21.
If you need your job, maybe you can put DD in a different center until Spetember?
ETA: Was any of what you and your boss talked about in email?

Unfortunatelt, they dont have to accomodate you after your FMLA runs out. Does your company allow people to donate sick time to others. My friend had friends at hers do this to help her extend the time.

It's really up to your boss. FMLA protects you up until 7/21. She can let you stay out till September unpaid, but that has to be her choice and she has to handle any hassle that she might have to incur.
Another option mght be to see if you can work from home till September and maybe come in a day a week? Do you have family that can help you out during that time span?
In the end it's your boss' decision. Your job is no longer protected after 7/21 so your boss will have to consider you worth the extra hassle of the extra month and a half or she can hire someone new. Sorry

I agree with everybody else -- your job will only be protected until 7/21. After that, when you are ready to come back I think they have to offer you the first available job for which you are qualified.

I made a huge mistake! I was going to put our convo's in a follow up email and didn't cause my other duties took too much time and I forgot!!!! I wish i did cause she ok'd me staying out until Sept, she knew my situation!

Unfortunately for me, i only have my bro & SIL up here and they both work, everyone else is on LI
I don't know what to do, I just have to wait til she comes back with an answer. Right now I am waiting for a response from the HR dept to tell her what to do.
I have worked my azz off for this company over the last 4 years, my stress level has been through the roof. I honestly blame my job stress for my m/c last year.
It wouldn't be the worst thing to happen since i was looking for another job when I got pg, and i have been looking since the end of june for a new job.
I am just soo angry at myself for not putting it in writing, and my boss for proving to me one more time that's she an moron and should check her facts before opening her mouth.

I would definitely start putting together a game plan to maybe work from home until September that you can present to them ASAP. Spell out how you are a valuable employee and what functions you could do from home.

Call the daycare center and explain the situation. Maybe the can rec'd a P/T solution and you can return to work P/T till Sept. Sorry about this. Always put this stuff in writing and have it SIGNED by yourself and your boss.

I def do this with everything else, nut with being out of work 1/2 time while pg and still doing 40 hours of work in 20 hours in a highly stressful, understaffed property it slipped my mind and now i screwed myself. A very hard lessoned learned, take care of me first!

I too should have had all my convos in email.. It ***** now looking back but I was a giant scatter brian come to the end of my term.. Now its like I was out with a serious disease.. and I am treated much different then I was before I announced I was pg... I should be done soon since DH is starting a new job.. Alls I can say is hang in there.. does work offer any help w/ daycare.. do you know any moms in the neighborhood that watch children.. believe me it is so hard to find and trust someone .. we are going through it right now.. your other option is to stay home until Sept and then find a new job.. We sucked it up.. I have the benfits so my dh is home withe her for now.. but we can't live like this forever so he will start soon and then I will be home and work part time sooner or later..

Well I learned my lesson the hard way, GET EVERYTHING IN WRITING!!
I spoke with my boss yesterday, since I am such a good employee, ya thanks, they decided not to terminate my employment, but kinda did give me "come back on 7/24 or else".
They are posting and replacing my position as of 7/24. SOoooo I no longer have my current position and because I am such a good employee, instead of termination, they are putting me on personal leave until i can come back in September. I work in property management for a big national company, and according to her, my property, my staff, and residents are suffering cause of lack of management, (I am a community manager). Total bull, by the way, cause I ran that property with less staff then what is there now, and by the way there's no manager there cause my boss messed up. She put someone there that I trained, then moved him 3 weeks into my leave!
Upon my return I can return to the next available position.
What the hell does that mean?
Oh did I put everything in writing this time and sent it off.

It sounds like you shouldn't expect your old job back, but that you can still work for them in some capacity.

Just make sure you get returning to your salaray in writing becasue since they do not have to hold your job they are not obligated to keep your salary (I believe).
