FMLA and teachers
Does anyone know if you can be forced to take the 12 weeks under FMLA even though you only requested to take 10? TIA

In my district they told me no. However if you carry insurance you would be cutting them a check for insurance while out and if you go back early you would have to make sure you dont right out a check and they don't take out insurance from your pay check too. Does that make sense?

I don't think so- in NYC you get 6 weeks for a regular delivery and 8 for a c-section. They don't force you to do FMLA.

You cannot be forced to take more leave than you want. You are entitled up to 12 weeks of unpaid leave under FMLA, but you can take less. I copied the relevant section of the FMLA below:
An employee may not be required to take more leave than necessary to address the circumstances for which leave was taken. If the employee is able to return to work earlier than anticipated, the employee shall provide the employer two business days notice where feasible; the employer is required to restore the employee once such notice is given, or where such prior notice was not feasible.

You can come back at 10 weeks. You can also use the remaining 2 weeks at a later time. FMLA does not have to be taken consistantly. You can use a day here or there.
