Got back from the UFT maternity workshop...
...and I wanted to share some info.
* You only get paid for the sick days you've banked. If you have more than 30, you can't use them all; you can only use sick days for the first six weeks (8 weeks for a c-section) that you're out. You can borrow up to 20 days if you don't have enough to cover the first six weeks, but don't have to. If you want to take days off before the birth, those come out of your CAR.
* FMLA will cover you for UP TO 12 weeks. (which includes the first six/eight weeks in which you're using sick days, or any days you take off prior to the birth). So if you take time off before the baby comes, that counts. Your health insurance will cover you for the duration of FMLA.
* If you want to be out longer... you can take a childcare leave. This will extend your leave to the following September, but you will not be paid or covered by insurance after FMLA expires. You can renew the leave of absence every year until the September after your child turns 4. You cannot return mid-year. If you have another child in the interim, this "resets" the clock.
* There are no paternity leaves. At all. However... if both you and your DH are DOE teachers, you could take FMLA and return to work, and then he could take an FMLA leave at that point. You could not take it simultaneously.

I am worried about senority....i want to do the fmla but there is one person below me.... and it is a difference of 6 weeks!!! ugh :/

The mid-year thing was news to me too. My original plan was to go back around December 2011. Turns out that if I want to take longer than the FMLA leave allows, I can only go back either in either Sept 2011 or Sept 2012

That must be new. After my FMLA ran out in the beginning of April I went out on childcare leave and came back in June. One of my friends went out in Oct and came back in April.

It's prorated for the amount of time that you're out and off of payroll. You lose roughly the equivalent of one week of summer pay for each month you're out during the school year.

Thanks for the info on the paternity leave. My DH will only be taking a few of his banked sick days off so it works out for us.
I work in a catholic school part time so any time i'm out I don't get paid but we're planning for this until I go back next September.

I thought that about the childcare (was told at the workshop).
I had baby in May, told FMLA skips summer (which it does) and restarts in sept. That would mean I return about NOV 1. My secretary said no I return Dec 1 because FMLA restarts in sept. ( i knew she was wrong, told her , but went along with it). GOt a call yesterday that I am to return Nov 1, but can take a childcare leave to Dec 1.
Im trying to figure that out, how is that possible, thought it was return after FMLA or take the year.
NYC is all messed up

yeah I know that stinks... but at least you will ahve extra days left over for when you return to work if you need to take them if the baby is sick. I have extra days left over too

Yea but depends on situation. See in my situation I went out May 27. Used sick days til the end of the school year. only needed about 4 weeks of my 8 (had a c/s). Since I was using sick days it was like I was working so my summer checks were never distrupted.
Then I had 8 weeks of FMLA remaining (since skips over summer) and off til Nov 1 if i go back, this next summers checks will be decreased a lot.
