Re: Has anyone ever sued a lawyer?
Sued them for what? If you think there is a breach of contract or incompitence on their part then I think it might be difficult to prove. If they were, lets say, working for someone else & harrassing you, or if you work for them & they are harrassing you at work, then it might be easier.
Just a guess though, no real experience. I would imagine though, depending on the circumstance, that it might be hard to find someone to represent you against another atty.

Re: Has anyone ever sued a lawyer?
I would think it would be more difficult than the average case, but if you are in the right and need to than I don't think the fact they are a lawyer should stop you.

Re: Has anyone ever sued a lawyer?
Are you talking about legal malpractice? It is hard to prove unless they did something extremely wrong. My firm has taken a few cases and it is so hard to prove.

If you have another atty then I am sure they will search all avenues to get your case won.
Sorry you have to go through a suit

You can also file a grievance against the lawyer with the NY State Bar Association (assuming its a NY lawyer). Click here for more info: Link

They did do something extremely wrong. They were our mortgage atty assigned to us by the mortgage company.

Good luck. Escrow issues are very top of legal malpractice claims. Just also keep in mind that a lawyer may not do this on a contingency fee. Make sure you discuss all fee arrangements up front. If this doesn't settle right away, it can get very expensive.

Were they actually representing you? Was it specifically an escrow issue? If your answer to both of these is NO, you may not have a good shot. If yes, give 'em hell.
Every situation is different, but I am a lawyer and 9 times out of 10, when people ask me if they can sue their lawyer, when we get down to it, there is not something to sue over. But I'm talking about people who didn't win a million bucks from their auto accident telling me that they should be able to sue their lawyer.

Re: Has anyone ever sued a lawyer?
It's not hard to sue anyone - it's hard to win though. It may not be worth your time & effort (even if you have free legal representation).
I would definitely file a grievance with the ABA.
