Health insurance cancellation
My husband has been out of work since January due to a back injury that occurred 12years ago at a different job. It flared up in Jan and it was recommended that he have surgery to fix it. He has been waiting since then to get his worker's comp case reopened and to get the approval for the surgery. He wanted to go back to work in Feb. because his back was feeling better. The doctor said he could go back on light duty. His job is not strenuous at all and does not involve any heavy lifting. He told his boss that he could work until he got the approval for the surgery, and train the person who would be filling in for him. The boss said that he can not come back until he has a letter stating that he can return with no restrictions.
So, a few weeks ago he went to a podiatrist (for an unrelated problem) and we just got a letter from Blue Cross saying that the claim was not paid because his coverage was terminated before the date of the office visit.
I was under the impression that the employer could not cancel his health insurance without giving him written notice and the opportunity to continue it through COBRA. Does anybody know if this is true or what the regulations are since he is still technically "employed" there. He has not been terminated or laid off.
We also went in to the office about 3 weeks ago, and he spoke to his boss last week. Nothing was ever said to him about cancelling his coverage.

It could be an error. I work for Empire, and to be honest mistakes happen all the time, where the dr's office puts the wrong date of birth for example and it denys as the coverage ended etc. Also, if the employer was late paying the bill, they will cancel everyones insurance and then re-instate it once the bill is paid, but the claim will stay there unpaid unless someone calls on it.
First, call Empire, ask if the insurance was cancelled in when. OR you can register ( you have to use DH's name and info) on www. Empireblue.com ( it is empire bluecross blueshield right??) and look at the coverage and the claim to get info. ( fm me if you need help)
IF in fact they cancelled it. They can cancel it at any time. Insurance coverage is a "perk" of employment, like vacation days. The employer can basically do whatever they want, and cancel at anytime, with no prior notice. BUT if the employer has over 50 people working there, they must by LAW offer Cobra. But they have 60 days to notify him of the cobra.
So...first things first, I would call the insurance, see if the coverage indeed ended and when. They cant tell you why though unfortunatly.

He doesn't contribute, and he hasn't gotten a paycheck since Jan when he went out with the back injury.
