Hi-Ranch - Is it a 1 Family or 2 Family if...
there is an apartment on the first level? The town sees it as a one family, but the Village sees it as a two family? Does that mean the wrong taxes are being paid right now. Confused!

I don't understand how it could be considered a 2 family without a permit from the town??

that is what is confusing to me. the appraisal came in as a 1 family, so I guess I'm going with that until we get a tenant in there and then we will see what the law is for that. Thanks!

If you recently bought the house and people before had a permit for a 2 family, those typically do not transfer so technically, it is back to being a 1 family. (The apartment is illegal though) I would go with 1 family unless you have a permit in your name saying it is a 2 family.

We are going to closing soon. Yes we were told we have to get a permit every year for the apartment if we have a tenant in it. We will apply when we are ready for the tenant, but for right now, then we will tell the insurance company it's a 1 family. Thanks for the help.

sure it does. it doenst transfer for a mother/daughter.
for the 2 family permit you just need to apply for it every year.
