How can I file a harrassement suit against a collections agency?
I simply cannot find out how to do this. A little background.
We were getting all these hang up calls from a 800# for months. About 3 weeks ago, I finally answered the phone and this guy identifies himself and tells me he's hoping I can help. He's been trying to reach Mrs.X for quite some time in regards to a legal matter and according to a background search, I came up as a relative of this person. He proceeded to give m a case number, the persons full name and the phone number he was trying to reach. Which I'm pretty sure by giving me that information without first verifying I was related to that person was illegal. I am not related to that person.
Anyway, I tell the guy that, take his name, and tell him to not call this number again.
EVERY SINGLE *****' DAY I come home to multiple hang ups from this company. They call on the weekends at all hours. I've already called them back 4 times telling them to take me off as a contact name on this matter, I do not know this person. They keep saying, okay no problem, we've removed your phone number. Tonight now they tell me, it's not them that's calling. Oh, okay.. that's why YOUR phone number comes up on my caller id...azzwipe!
They are relentless, and I would really like the phone calls to stop, but don't know how to go about doing so. Do I just call the phone company, or is there some other place I can contact?

I'd go to BBB first and let them know what is happening. They will contact the company.
So frustrating though.

as long as you have the companies name and address (you can find the info on address etc if you know the name on credit boards.com )
send a certified retrun receipt letter with all the info and say you'll take legal action if they dont' cease all communications immediately

Do not pick it up AT ALL COST!!! After about 3 weeks they will stop.
We had a former tenant (over 2 years ago!!) who keeps giving our address and telephone number. We have collection agencies calling us to talk to him. Letters in the mail. I filed a fraud complaint with the post office and explained that someone was using our address in a fraudulent way.
DH asked one of the collection agencies what we were supposed to do. They said they were "obligated" to call at the number provided. It's generated by their computer.
So after getting phone calls 3 times per day at the same time for weeks, I tried the no answering technique. It takes about 3 weeks for them to stop. If you pick up, they will keep calling.

They're not looking for someone at this number. They wanted me to contact the person they are trying to reach and have that person call them since they think I'm a relative. We were getting phone calls for a long time before I finally answered. That was 3 weeks ago. I have not answered their calls since, but I have called them and did threaten to file a harrassment claim... I was told "do what you have to do"

Tell them you are going to contact the FTC, this is against the law. You should also google the phone number and see what comes up. They will stop but you should send a letter to the FTC.

Wow.
Don't mess around with weak complaints to the BBB or FTC.
Find an attorney that handles FDCPA and TCPA cases and just sue them and earn money off them.
It's real easy. I wish they would call me because they would be paying for my vacation.

Yep! I agree 100%. First of all i think in NYS it is illegal for a collection agency to speak to anyone but the debtor. So if you do know the person they are trying to contact, they can actually probably take legal action as well for giving their information to you. I would contact an atty. The first thing they will probably do is send a cease and decist letter. Going to the BBB is going to do nothing. Google FDCPA national list of attorneys.

Hahah! I was JUST about to post this website. He's right in West Islip. Definately go on the site and check out the overview of the law section. Especially the part about contacting friends, neighbors and relatives

Wow... I worked with Joe on my cases. I didn't even know he had a website or was even on the news. 
Looks like he is making it big. Good for him.
Definitely contact him. Don't know about him taking a "third" because you can sue for your attorney fees under FDCPA so the only thing he should be taking is the debt collector's money.

thank you for this. I get calls ALL DAY LONG for two relatives and I have told them 100 times they dont live here, and yet at least 8 calls a day. 9:02 pm on a sunday a few weeks ago!!!!!!!!!
