If he gets the money, he is immediately going to jail. It is a federal offense to get money (either before or after the transplant) for human organs.

A. no morals... B. control freak c. what is he going to do with it?put it back? woudn't it be ironic if he passed during surgery?
I hate spiteful people. You do something nice because you want to. Now the whole world will know him and think hes crap

A Long Island doctor whose wife dumped him for her physical therapist after he gave her his kidney is suing the mother of three for the $1.5 million that he claims the organ is worth.
"I saved her life and then to be betrayed like this is unfathomable. It's incomprehensible," said Dr. Richard Batista, 49.
He said his wife, Dawnell Batista, started running around behind his back with a physical therapist she met in 2003 while recovering from a knee injury she suffered during karate lessons.
"She engaged in an extramarital affair and refused to go to marital counseling and reconciliation," he said.
"She slapped me with divorce papers in the operating room while I was trying to save another patient's life."
The doctor, who works as a vascular surgeon at Nassau University Medical Center, said that since filed for divorce in 2005, she has refused to let him see his three children, ages, 8, 11 and 14.
"The main reason the doctor is doing this is because of how he's been treated in this case," said Dominic Barbara, Batista's lawyer.
They are asking for the $1.5 million as part of the distribution of assets in the divorce.
They found a medical expert to estimate the value of the kidney.
"This has never been done before in the state of New York," said his lawyer Dominic Barbara. "In theory we are asking for the return of the kidney. Of course he wouldn't really ask for that but the value of it."
According to this article, SHE'S the scumbag that cheated on him and is refusing to let him see his kids, and divorced HIM.... if this is true, he deserves the money (but not "for" the kidney, since that's illegal, but I'm sure they can reword it so it's just for "pain and suffering")

He feels he was used, in a way I can understand where he is coming from, but give me a break!

oh but what about what HE may have done to HER. making her feel like she is trapped because HE gave her the kidney? making her feel like he is god? that because he did this for her she is force to stay with him even if she is miserable in the marriage?
we are only getting his side, if i was to be made to feel like i OWE him something that is wrong.

I agree we are only getting one side, people are just soooo strange. I think I would be hurt but I do not think I would go to this extreme.........I don't think any of us know until we are in this situtation what we would do.

We also have to consider that he gave her the kidney in 2001. That was 8 years ago. Things could have been much different in their marriage at that time.

i saw that on GMA and in the paper. she got the kidney 8 yrs ago. yes, i feel bad for the guy....how could she cheat on him after he saved her life. they're going through a messy divorce. the paper said he hasn't been able to see his kids in months

its sad that this has come down to this, but I really feel bad for their kids. Divorce is soooo hard all by itself, but now those kids have to go to school and everyone knows there business. Very sad.
I can understand how he is mad she cheated, but ask for all the jewelry back! you gave someone you loved something, no matter what, it doesn't give you rights to ask for it back, especially in the form of money.
If he wanted $$ he should have brought the truth and facts of her cheating into the divorce so that he could get alimony and leave it at that.

My point was that he's not likely to get ANYTHING for the kidney.
I do give his lawyers props for the extremely creative way they are trying to get around the criminal law, though.
What bothers me most about this entire thing is that this sends a message to your kids that basically says, "If I knew this would end up this way, I wouldn't have wanted to save your mother's life" and "I think because we're getting a divorce your mom should give me back that kidney b/c she doesn't deserve to live anymore in my eyes... unless she pays me."
He's a sick *******.

I do think it's kind of harsh on her part that she cheated on him.
I mean I understand marriages dissolve but the man saved your life, at least have enough respect to not cheat on him.
