How do you feel about this new sex offender legislation?
Got this in an email. ~~~~~~~~~~~~~~~~~~~~
Dear Friend:
I am pleased to announce an agreement between the State Senate, the State Assembly and the Governor on a measure that will protect women, children and all New Yorkers from dangerous sex offenders. The legislation will provide civil commitment of sexually violent predators at a secure treatment facility after they've completed their prison sentence if it is determined they are at risk of attacking again.
Under the bill, sex offenders will go through a review process to determine if they are likely to be repeat offenders. If after a trial, a jury confirms the findings of the review process, a judge will determine the most appropriate course of action, either confinement for the most dangerous offenders or a program of strict and intensive supervision for those who pose a lesser risk.
It's an unfortunate reality that some sex offenders simply cannot be rehabilitated and given the opportunity, they will strike again. This legislation is necessary to protect New Yorkers from these dangerous predators. The civil commitment legislation is expected to be signed into law in the coming weeks.
Sincerely,
Senator Charles J. Fuschillo, Jr.

On a personal level, I think anything that will protect my children more is great. But how is it legal to force them to live in these facilities if they've served their sentence?

I agree. And I am curious as to what type of reveiw process will be used to determine if these men/women will be a very dangerous threat or a lesser threat.

Will this legislation change future sentencing to include such review & "treatment?" Will it be like a parole board, or will it be Drs & such giving these evaluations?
I am all for trying to do anything to protect society-at-large from sex crimes & other violent offenders, but I wonder how Chuck sees this panning out in reality.

As an attorney, a civil rights attorney no less, I'm somewhat ashamed to admit this, but I'm all for it. I think this country, and the legal system even more so, has become so caught up in treating people "fairly" that we've lost a sense of what punishment and even more so, what protection is all about, and the scales are now skewed in favor of our perverse concept of justice instead of protection of those who cannot protect themselves. I TRULY, truly believe that sexual predators in no way, shape or form can be rehabilitated, and for some reason is becoming more and more predominant, and we must, MUST address it instead of getting caught up in debates over what is and is not fair for the predator.
Sometimes, I really do believe we should go back to the good ol' days of community stoning
