I don't think you can do a classaction lawsuit for something like that. But I am not an attorney, so I don't know.

I have a compaq as well - what types of problems are you having with it?
WELL First 1 week before my wedding I had problems where my battery connecter (the part that the plug to charge it plugs in to) was falling out! So it wouldn't hold the charge. Called compaq they send me a new bat. It wasn't the bat.. So 4 days before the wedding I FEDEX my laptop to them. We got it back the MORNING of my wedding and had a lot of honeymoon stuff stored on it and were going to take it with us. We CARRY it with us to hawaii only to find out they never hooked something up inside. So it wouldn't work! Mike fixed it when we got home.
It worked for another year... It crapped out. Took it to best buy. They told us it was the hard drive. Spent 350.00 on a new hard drive. It worked for 2 weeks and it broke AGAIN the plug. Come to find out that that is a motherboard issue. A new motherboard is almost 500.00. It was a 1300.00 laptop to begin with. I don't think I want it to be over 2grand.
WELL we are fighting with compaq right now (actually my DH is) So I did a google search...
Product Rating: Ease of Use: Quality of Tech Support: It was great....for two years by mariorf ,May 04 '05 Pros: Great Screen Fast for processing and CD burning Cons: Defective design of the motherboard
And came up with this
Great processor speed, 512MB of RAM and very portable.
After two years the connector to the Power Adapter became loose and eventually fell off. Unfortunately to replace the motherboard, it would have cost the same as a new computer. The computer only last two years. For that, I'll give it 2 out 5.

Re: How do you start a class action lawsuit?
I had the same problem with the battery. Mine will be 4 years old in January. this past January, I noticed that it would start just randomly turning off and realized that it was the plug in the back.
We took it to Best Buy for this problem and they were absolutely no help. I now actually don't even use the battery anymore - I just keep it plugged in and run it off the wall outlet.
It's so strange, because since I took the battery out, it hasnt randomly shut off once. It doesn't really make sense, but it works.
The only thing that really sucks is that I have to be tethered. No more roaming around the house with the laptop.
Sorry to hear about all the other probs you had with yours. I will never buy another Compaq. I thnk once this one finally craps out, I am switching to a Mac.

HOW FUNNY. Compaq (or really HP) just told mike they have never "heard of this issue" But yet... I am talking to you and you had the same problem (think about how many other people are out there)
It just sucks cause I spent a lot to begin with and I don't have the money to buy another one! I bought a "good" one thinking it would last and it lasted really all of a year! If so MANY people are having this same problem there has to be SOMETHING we can do!
ETA NEVER again will I buy HP/Compaq

I had this problem with my Dell laptop - so did a number of people who had Dells in my law school - all of our motherboards went (and strange coincidence they all went within a 2 month period) I got rid of the dell and got a sony and never had a problem again.

Re: How do you start a class action lawsuit?
I'm dealing with a similar class action lawsuit right now, so yes, this is the kind of action you could pursue. You would have to find an attorney that specializes in these type of class actions and consult with him/her.

Re: How do you start a class action lawsuit?
I just did a quick google search and found a few firms with offices in NY that handle consumer protection and defective product class action lawsuits. It couldn't hurt to contact them and see what they say. Good luck.
Cohen Milstein
Lieff Cabraser
