Human resource benefits info
Can someone help me out. I am not clear on how this works. MY dh was giving in his 2 weeks today to start another job and they told him he can resign today. I am 8 months preggo starting my own benefits Oct 1st. He paid for the month of october (from what I thought). His company just told us that his benefits end when he resigns. So they plan to terminate our coverage tomm. I know its just 4 more days but I am preggo. How can they terminate them before the end of the month? Not understanding this...

I thought that they had to offer you COBRA even if you left a company. I would have him ask about that....you should not have a lapse in your insurance.

I've never heard of that.
You've already paid for the month, so you either need to get a refund or they should cover you for the remainder of the month.
But it has been a while since I was in a benefits role, so I could be wrong.

He pays for the coverage? If so, they cannot terminate it untill September 30th.
They are not obligated to offer him COBRA, unless he asks for it.
ets: The law about COBRA is dependent on the number of employees. IF I were to quit today, my company would not have to give me COBRA even if I asked for it.

It is illegal not to offer COBRA. He needs to speak with an HR rep. Plus insurance has to be paid the month before so it is complete bullsh*t that he would lose coverage right away!!

Sorry to not have answered some of the above questions in my OP. Cobra he was offered which I "think" can be put into effect within the next 60 days...so you are right...if God forbid something happens between now and oct 1st...Yes, I would put in for their thousand dollar cobra In terms of my benefits question...If you pay sept 1- sept 31st...whats the deal cutting you off at the 25th bc you resign? Yes, i think they are willing to credit him the 5 days but who wants a credit vs being covered

It sounds like HR has an agenda with telling him to leave today and then this bs with the insurance. It's paid for and by law they have to offer cobra so they are way ahead of themselves saying his policy will be cancelled effective today.
And I would be shocked if the insurance company would give a credit for 5 days - our ins. company only allows cancellation on the 15th and the end of the month.

A) Call the Ins. Company
B) They told him to leave today for several reasons:
1) No time to download contacts on to a disk 2) No time to take company info with him...if he works for "Smith Barney" he does not have time to organize stuff to take to "Morgan Stanley" 3) No time to say goodbye...he does not make a distraction from work by having a goodbye party or running around telling his friends goodbye. He is out the door in a flash.

The insurance contribution is "per pay period" whereas Cobra premiums are per month.
The decision about when to terminate coverage is made when a company purchases a policy. The options are: end of the months; 15th of the month, date of qualifying event.
In this case, it's "date of qualifyng event"
OK...I agree that todays the qualifying event BUT he worked today which means this day (monday) should be calculated in the next pay period bringing us to oct 1st. I dont believe or understand credits. I would think its the 15th or 30th cut off.

also one more thing to add....How would cobra begin on the 26th of a motnh...wouldnt it begin on the 1st? How do you pay for days? Thats the same reason I dont understand why you would be credited for days. Seriously, we are talking about like 4 days...his company nneds to get a clue.

If you work in NY, State Continuation applies. You would be eligible for Cobra.
If the company has less than a certain amount of employee's then the law does not apply to them. That is what I was taught.

Many employees assume that their deduction entitles them to coverage for a certain amount of time (a week, a month, the current pay period), but it does not.
When you elect to participate in your employers health plan, you are agreeing to have a specified amount of money taken out of your pay each time you are paid.
The termination of benefits date is determined by the health insurance policy that your company has with the health provider. Your paycheck deduction as no effect on your termination of benefits. It's simply a "per pay period deduction"

As for why they might be making a big deal about 4 days, if anything should happen incurring medical costs it would count against their insurance, so if you and DH were in a horrific accident tonight those medical costs would affect the companies insurance, possibly causing it to increase greatly. One of the reasons our company's insurance has jumped is because of some excessive medical costs incurred by employees.

Thank you for all your info! Makes sense but doesnt make me happy! I guess I will pray nothing happens in 4 days and god forbif if it does...i will elct cobra.
